PUPPY PURCHASE CONTRACT
I. DEFINITIONS USED HEREIN INCLUDE:
A.) "BUYER" is defined as the signer of this contract;
B.) "BREEDER" is herein defined as:

C.) "PUPPY" is defined as: one Pureblood Standard Poodle PUPPY, who can be registered with the American Kennel Club (herein "A.K.C.");
II. THIS IS A LEGALLY BINDING CONTRACT BETWEEN BREEDER AND BUYER:
A.) This contract constitutes the entire agreement between BREEDER and BUYER with respect to the PUPPY being sold and purchased herein; This non transferable contract documents the sale & purchase of a Rocky Mountain Luxe Puff Poodle, the BREEDER'S health guarantees & both parties rights & responsibilities; BREEDER neither makes nor implies any warranties or guarantees, express or implied, other than those written in this agreement, including without limitation, the warranties of merchantability and fitness; BREEDER shall not under any circumstances refund to BUYER any portion of the DEPOSIT / PURCHASE PRICE / Extended Care / Shipping / and or Delivery Costs received from BUYER; BUYER's signature herein indicates that he / she has read, does understand, and agrees to all the terms and conditions of this Contract;
B.) This contract and the terms herein, including PUPPY purchase price is good for the term of 6 (six) months from the date of BUYER's signing:
1.) BUYER AGREES that, if BUYER signs this contract, pays in full, then fails (for any reason) to pick a PUPPY and instead dies not choose any available PUPPY for longer than a 6 (six) month time period, then:
a.) BUYER shall have abandoned this PUPPY purchase contract, forfeited their payment, and will not be contacted by BREEDER regarding any future litters ( I.E. BUYER cannot "ride the wait list" for longer than a 6 (six) month time period); and
b.) If BUYER - at any time after their abandonment of this contract and forfeiture of their payment at 6 months, decides, that they are ready and wish to complete the purchase of an available PUPPY, then BUYER agrees that the following stipulations shall apply:
(1) BUYER must: fill out a new application and if reapproved by BREEDER, must sign a new updated contract if this contract is out of date / is no longer being used by BREEDER / and has been updated in any way); and
(2) BUYER agrees they shall pay the total difference in price between their original purchase price and the then current purchase price of a PUPPY (if the then current purchase price of a PUPPY is more than what is agreed to herein); and
(3) BREEDER shall subtract BUYER'S original payment from the then current total purchase price for the sale of a PUPPY, the amount of which will then be the amount BUYER agrees shall be due in order to complete their purchase of a PUPPY; and
(4) BUYER shall then be permitted to pick their PUPPY from any available puppies;
III. BUYER'S AND BREEDER’S RESPONSIBILITIES TO HEALTH OF PUPPY:
A.) This Contract, and the GUARANTEES HEREIN, are in place for the entire LIFE OF THE PUPPY; BREEDER has done everything in her power to produce healthy and sound puppies. To that end, BREEDER will supply BUYER with health records documenting the health treatments PUPPY has received, including tail docking, the removal of dewclaws, veterinary health checks, vaccines and deworming treatments; and
1.) BREEDER GUARANTEES that PUPPY is healthy at the time of PICK UP (by BUYER, by Proxy for BUYER and or by GROUND or AIR TRANSPORT arranged and paid for by BUYER); In the case of AIR CARGO DELIVERY, BREEDER Guarantees PUPPY is healthy at the time the airplane lands, which is herein mandated to be “the time of PUPPY DELIVERY/RECEIPT"; and
2.) BREEDER does NOT assume any liability for any injury to and or illness of said PUPPY contracted by or sustained by PUPPY - including eye injuries - after DELIVERY/RECEIPT of PUPPY; and
3.) Some things are out of BREEDER'S control; therefore BREEDER does NOT Guarantee PUPPY against any common or idiopathic ailments including but not limited to: a.) parasites, including coccidia and or giardiasis, and any viral or bacterial diseases / disorders brought on by parasites, b.) retained testicles (cryptorchid), c.) involuted vulva or vagina, d.) umbilical hernias, e.) what PUPPY'S size, weight or final coat color will be at physical / sexual maturity, f.) adolescent "Base Narrow" teeth mis- alignment (see below), g.) ear infections, h.) hip dysplasia and or Luxating Patellas, h.) the development of disqualifying faults, diseases, or disorders, which are due to BUYER's negligence, chance, or environmental conditions, including but not limited to: Vaccinosis (I.E. Vaccine injury), Cancer, Addisons, Autoimmune / Immune Disorders (including Sebaceous Adenitis and or Food / Skin Allergies), Digestive Disorders, Bloat; and
4.) All guarantees outlined in this contract will be null and void if BUYER (a.) fails to provide routine veterinary care, (b.) if PUPPY is spayed or neutered before 24 months of age, (c.) if PUPPY is Bred (intentionally or not), (d.) if PUPPY is injured by accident or neglect or (e.) If PUPPY IS VACCINATED with any vaccines in addition to or other than Distemper, Parvo, Bordetella and or Rabies vaccinations, (f.) if PUPPY has undergone any surgical intervention to any base narrow tooth prior to PUPPY reaching 12 months of age, (g.) and / or if any of the terms of this agreement are not followed by BUYER; and
B.) BUYER agrees to have PUPPY examined by BUYER'S veterinarian at BUYER’s expense, within 3 (three) days of RECEIPT of PUPPY and shall email BREEDER Veterinary documentation of mandatory 3 day health check having been performed; if BUYER does not have PUPPY examined by veterinarian within 3 days, any and all Health Guarantees by BREEDER documented herein are nullified by BUYER'S non compliance of this contract; but does NOT void nor nullify any of BUYER’S responsibilities to PUPPY and to BREEDER; and
1.) In such a case as diagnosis of a genetically unhealthy PUPPY by BUYER'S veterinarian is made within 3 (three) days of DELIVERY:
a.) BUYER shall immediately notify BREEDER of said diagnosis by phone - AND in writing via email to luxepuffpoodles@yahoo.com; and
C.) In order to safeguard against Cancer, Allergies, Addison's, Anaphylactic Shock, Seizures, Brain Damage and countless numbers of Autoimmune Diseases, BUYER will ONLY have PUPPY vaccinated with Distemper, Parvo, Rabies and Bordetella vaccines; Any additional vaccinations administered to PUPPY, at any time during it’s lifetime, without Breeders express written consent, BUYER’S will nullify and void any and all BREEDER health guarantees contained herein; and
D.) In order to safeguard against Hip Dysplasia created by nutritional deficiencies and or overwork / stress before PUPPY’s growth plates have matured, BUYER shall:
1..) refrain from: any strenuous or extended hiking, bike riding with or running, pulling of or placing of weights by / upon / and or with PUPPY until after PUPPY is older than 2 years of age; and
2.) feed PUPPY a "non grain free" dog food rated at 5 stars on www.dogfoodadvisor.com, as low grade dog foods will cause nutritional deficiencies and health issues in your Standard Poodle, and
3.) BUYER shall not feed PUPPY any PURINA dog food products nor any dog food containing GMO Corn, Wheat or Soy, nor any grain free dog food;
E.) BUYER agrees and shall enroll PUPPY and complete basic obedience training and or "Good Citizenship Training" with PUPPY;
1.) BUYER must provide BREEDER with name, phone number, email address, website and contact information for any trainer who trains puppy.
2.) If there are any serious behavioral issues BUYER must:
a.) provide BREEDER with clear, full sized, dated recent videos of said behavior, and place their PUPPY in a 2 week professional dog training course.
b.) mandate that their professional dog trainer communicates directly and openly with BREEDER- and that TRAINER must also provide BREEDER with videos of unwanted behavior if requested by BREEDER.
IV. SPAY/NEUTER, BREEDING, RELINQUISHMENT, REHOMING AND RESALE:
A.) SPAY or NEUTER: BUYER is purchasing PUPPY, as a pet or service dog, with Limited A.K.C. Registration; BUYER shall SPAY or NEUTER PUPPY, after PUPPY reaches 24 months of age, and before PUPPY reaches 25 months of age; (A Vasectomy is not an acceptable "Neutering" for the purposes of this Contract, I.E. - all male PUPPIES must have their testicles removed.)
1.) If spay or neuter is performed either before 24 months of age, or after 25 months of age, all contractual BREEDER health guarantees are null and void, unless BREEDER expressly AGREED to it in writing; and / or unless earlier spay or neuter was deemed necessary by BUYER'S Veterinarian because of a health emergency; and
B.) PROHIBITION AGAINST ANY AND ALL BREEDING: BUYER is expressly PROHIBITED FROM ANY AND ALL BREEDING of PUPPY to any other dog, including accidental breedings, at any time during PUPPY'S lifetime; and
1.) If, prior to spay or neuter being performed, PUPPY does breed with any other dog, and said breeding (intentional or not) produces any offspring, said breeding and offspring VOIDS AND NULLIFIES all contractual BREEDER HEALTH Guarantees, but does NOT void nor nullify any of BUYER’S responsibilities to PUPPY and to BREEDER; BUYER shall notify BREEDER of any and all matings / pregnancies and or of all puppies produced by PUPPY and BUYER shall immediately pay BREEDER an additional $3,000.00; and
2.) If PUPPY is a MALE, BUYER shall have neuter performed on PUPPY immediately after any mating / breeding, regardless of age and or if breeding was intentional or accidental; If PUPPY is a FEMALE, BUYER shall have PUPPY spayed 2 weeks after all puppies have been weaned; and BUYER'S Veterinarian shall provide BREEDER proof of spay or neuter being completed; and
3.) BUYER is further expressly prohibited from SELLING any offspring produced from PUPPY, and shall REHOME any and all puppies; BUYER shall not charge any more than a $100.00 REHOMING FEE per puppy; BUYER is also expressly prohibited from relinquishing any puppies produced to any animal shelter and shall personally keep and care for all puppies until such a time as they have been REHOMED into safe and suitable homes; Further, BUYER shall donate all $100.00 REHOMING FEES collected for said puppies, to their local animal shelter; and
C.) LIFETIME COMMITMENT FOR CARE: BUYER agrees that this purchase of PUPPY is a commitment to care for the PUPPY for PUPPY'S entire lifetime; To that end, BUYER shall not at any time nor for any reason:
1.) SELL PUPPY, nor,
2.) RELINQUISH PUPPY to any animal shelter, nor,
3.) RELINQUISH or REHOME PUPPY to any person or business OTHER THAN BREEDER; and
D.) RELINQUISHMENT: If at any time and/or for any reason, BUYER cannot take proper care of PUPPY and needs to RELINQUISH PUPPY:
1.) BUYER shall immediately notify BREEDER in writing via email and verbally via phone call/text of their need to RELINQUISH PUPPY BACK TO BREEDER and shall immediately transfer the AKC ReUnite Microchip into BREEDER’S name alone and must send BREEDER- via overnight FED EX or IPS (NOT USPS) PUPPY’S signed AKC Registration so BREEDER can immediately transfer the AKC Registration into her name alone;
2.) BREEDER shall have the sole discretion regarding all aspects of REHOMING PUPPY; BREEDER shall (within 2 weeks of BUYER’S RELINQUISHMENT), either:
a.) Transport PUPPY back to her residence, or
b.) Place PUPPY into a suitable and immediate TEMPORARY home or REHOME PUPPY into a PERMANENT home all of which shall be of BREEDER's choosing (I.E. BUYER shall have no decision making power as to into which temporary or permanent home PUPPY will be placed); BREEDER and BUYER shall communicate and work cooperatively to facilitate a fast and easy physical transfer of PUPPY from BUYER'S home to either BREEDER'S home or to a new (temporary or permanent) home; and
3.) RELINQUISHED PUPPY shall NOT be SOLD by either BUYER or BREEDER, but shall be REHOMED by BREEDER, into a safe, loving permanent home, directly from either BUYER’S or BREEDER’S residence (or from temporary home of PUPPY post BUYER'S relinquishment); and
4.) BREEDER (not BUYER) is is sole responsible for finding and choosing PUPPY’S TEMPORARY and or PERMANENT home and shall do so by word of mouth, by advertisements, and/or by utilizing any and all means necessary and available to her; BREEDER (not BUYER) shall screen ALL potential homes (including those suggested by BUYER) until BREEDER (not BUYER) deems a suitable TEMPORARY or PERMANENT HOME - is found; and
a.) In the case of RELINQUISHMENT, BUYER shall NOT be REFUNDED any money by BREEDER; and
E.) Prior to any relinquishment because of behavioral issues - BUYER shall hire a professional IACP CERTIFIED dog trainer for evaluation and will commence a minimum of 2 weeks of professional dog training prior to relinquishment;
V. BREEDER GUARANTEE AGAINST ADULT "BASE NARROW" LOWER CANINE TEETH:
A.) DEFINITION: "Base Narrow" bottom adolescent canine teeth can develop in some young Standard Poodle puppies as there can commonly be insufficient room in their very small, very thin developing jaw for all of their large adolescent and or new adult teeth to sit in proper alignment (on the outside of the upper jaw/gum); This can lead to, for a short time during development, one or both of the bottom two canine teeth poking into the top gum or into the top palate, sometimes causing small holes or indentations in the gum or top palate. "Base Narrow" is not an overbite or an underbite; and
1.) In most other dog breeds with normal sized jaws (such as Boxer, Pit Bull, German Shepherd, Australian Shepard, Pug, Labrador Retriever, Irish Setter, etc...) "Base Narrow" is an inherited genetic malformation as their jaws are large and wide enough for their adolescent teeth to have proper placement and alignment. "Base Narrow" in normally sized jaw dog breeds should be corrected, and the breeding pair should be spayed / neutered to remove the possibility of producing more puppies or dogs with this genetic issue; and
2.) In Standard Poodles, as well as in other thin jawed breeds (such as Greyhounds, Afghans, Borzoi and some Terriers, etc...) "Base Narrow" is a common part of the normal healthy skull / bone / jaw / and tooth development of some puppies; Well bred dogs of these thin jawed breeds will OUTGROW any adolescent "Base Narrow" teeth, which naturally corrects itself as the puppy's skull and jaw grow large and wide enough for their bottom canine teeth to sit correctly in the jaw, resulting in the eventual proper adult tooth / jaw alignment with their top jaw and teeth; and
B.) UNNECESSARY AND DANGEROUS EARLY "BASE NARROW" SURGICAL INTERVENTION FOR STANDARD POODLE PUPPIES: There are unfortunately some unethical or uninformed veterinarians who mislead and scare new Standard Poodle puppy owners, pushing them into what is completely unnecessary, though dangerous and very expensive surgery to remove completely / or shave the tip off of adolescent "Base Narrow" Standard Poodle puppy teeth; and to do so before the puppy's teeth, jaw and skull have time to naturally mature, reach full size and organically reach their correct tooth alignment. Such veterinarians:
1.) financially enrich themselves at great physical cost to the Standard Poodle puppy itself, and at great financial and emotional cost to the unwitting new Standard Poodle puppy owner,
2.) Further, they may do this by providing the new owner completely false, mistaken and or misleading information regarding what Standard Poodle "Base Narrow" is, and or by omitting what "Base Narrow" is in wide jawed dog breeds vs what "Base Narrow" in Standard Poodles is; and
3.) BREEDER hereby unequivocally states that the surgical removal of or "shaving off" the tip of a "Base Narrow" Standard Poodle Puppy tooth PRIOR to PUPPY reaching 12 months of age, in well bred Rocky Mountain Luxe Puff Poodle Puppies are:
a.) Surgical procedures that are dangerous to the puppy itself and,
b.) are almost always completely medically unnecessary; further that these surgeries can cause other medical issues in the PUPPY and later as an adult dog (such as huge gaping holes extending into the skull, missing or shaved bottom canine teeth, nerve damage, dental issues later in life and all or any number of health issues that can develop from them) - that would otherwise not exist if the PUPPY'S teeth and jaw had been permitted to grow unimpeded and naturally develop into what would have otherwise been their proper tooth alignment; and,
4.) BREEDER hereby unequivocally states that all Rocky Mountain Luxe Puff Poodle Puppies with an occurrence of "Base Narrow" bottom canine teeth: are developing correctly as nature intended and that by 12 months of age, 99.999 % of Rocky Mountain Luxe Puff Poodle puppies shall "outgrow their Base Narrow" tooth misalignment after their skull and jaw have grown in size resulting in sufficient room for proper bottom canine teeth placement and alignment (on the outside of / and snugged up against the outside of the top jaw and gum; and,
5.) Adolescent "Base Narrow" teeth are a common occurrence in normal, healthy Standard Poodle puppy skull / jaw / bone / tooth growth and development, BREEDER will NOT support, pay for nor refund any cost of any medical intervention or surgery to any "Base Narrow" Tooth in any PUPPY prior to a PUPPY actually having "Base Narrow" teeth upon reaching 12 months of age; and,
6.) BUYER shall refrain from any medical intervention / surgery to any "Base Narrow" tooth PRIOR to PUPPY reaching 12 months of age; Any BUYER who has any medical intervention / surgery done to a "Base Narrow" tooth prior to PUPPY reaching 12 months of age, does so at their own risk and financial cost; further any early intervention / surgery to any "Base Narrow" tooth to any PUPPY who is younger than 12 months of age will render all BREEDER health guarantees contained in this contract NULL AND VOID; and,
C.) BREEDER GUARANTEE AGAINST ADULT BASE NARROW: This guarantee is subject to the following terms and conditions, all of which are at BUYER'S expense:
1.) If "Base Narrow" bottom canine tooth or teeth are diagnosed by BUYER'S veterinarian to have persisted after PUPPY'S first birthday, BUYER shall immediately notify BREEDER of said diagnosis by phone AND in writing via email to "luxepuffpoodles@yahoo.com"; and
2.) BUYER'S veterinarian shall send BREEDER an email to "luxepuffpoodles@yahoo.com" containing:
a.) The following clear, CLOSE UP, full sized, color, dated digital photographs, taken by BUYER'S veterinarian, (taken without any obstruction blocking or distorting view of the Base Narrow Teeth), specifically of: (1) PUPPY'S CLOSED JAW: taken from the SIDE, clearly showing Base Narrow tooth placement, and; (2) PUPPY'S OPEN JAW, taken from the SIDE, clearly showing Base Narrow tooth placement, and; (3) PUPPY'S OPEN JAW - OF BOTTOM TEETH, taken from in front of the nose looking straight down into the mouth, clearly showing Base Narrow tooth, and; (4) PUPPY'S OPEN JAW - OF UPPER JAW AND TOP PALATE, taken from in front of the nose looking straight up into the mouth, clearly showing where base narrow tooth is protruding into gum or top palate; and (5) PUPPY'S CLOSED JAW, taken from in front of the nose looking straight into the mouth, clearly showing where base narrow tooth is protruding into gum or palate; and
b.) a digital photograph of PUPPY and BUYER in veterinarian's office on the same day photos of base narrow teeth were taken; and
c) a digital photograph of veterinarian’s microchip scanner with PUPPY'S entire microchip number clearly visible; and
d.) a signed letter from veterinarian confirming: (1) They diagnose Base Narrow Canine tooth or teeth, (2) they personally took all photographs, (3) that they personally scanned the microchip number of PUPPY photographed; and
e.) BUYER'S veterinarian shall email BREEDER, 2 to 4 digital radiographs (one of open mouth, one of closed mouth) documenting base narrow tooth to BREEDER at address specified in Part I. B. of this contract; and
3.) BUYER'S veterinarian will email BREEDER a copy of all medical records of the PUPPY and the final bill and all for treatment and or removal of Base Canine tooth or teeth in PUPPY; and
4.) BREEDER hereby Guarantees that if, after reviewing the documentation and medical records - BREEDER'S veterinarian confirms that PUPPY has any "Base Narrow" bottom canine teeth persisting at 12 months of age: BREEDER will refund BUYER up to but not exceeding $600.00 of the total cost of having up to two Base Narrow teeth corrected (removed or shaved) by BUYER'S veterinarian;
VI.) PUPPY IS GUARANTEED AGAINST "AFFECTED" DNA : of Von Willebrand DiseaseType 1 ( vWF1), Neonatal Encephalopathy, Degenerative Myelopathy, and or Progressive Retinal Atrophy - Progressive RodCone Degeneration (PRA-PRCD), under the following terms and conditions:
A.) ALL costs associated with DNA testing as well as those associated with BUYER and or BUYER'S veterinarian(s) complying with these contractual terms/conditions and deadlines - are incurred sole at BUYERS expense; and
B.) BREEDER shall not accept any DNA testing conducted (swabbed and or submitted) by BUYER; DNA testing and submittal must be performed and submitted by BUYER’S veterinarian, who must:
1.) digitally photograph PUPPY and BUYER in veterinarian's office at time of DNA swab; and
2.) swab PUPPY for DNA while scanning, photographing and denoting PUPPY's microchip number on the DNA testing paperwork application and envelope; and
3.) digitally photograph DNA envelope before it is mailed to the testing facility, and then personally submits PUPPY'S DNA for testing, marking themselves as the sole recipient for results; and
4.) Upon receipt of DNA test results denoted "Affected" for Von Willebrand DiseaseType 1 ( vWF1), Neonatal Encephalopathy, Degenerative Myelopathy, and or Progressive Retinal Atrophy - Progressive Rod Cone Degeneration (PRA-PRCD)VwD, BUYER'S veterinarian shall email BREEDER to "luxepuffpoodles@yahoo.com" the following FULL SIZED, timely, clear and clearly legible digital photographs of:
a.) PUPPY and BUYER in their office at time of DNA test,
b.) digital photograph of microchip scanner at time of test with PUPPY'S microchip number clearly legible,
c.) the DNA swab envelope before it was mailed;
d.) the DNA test RESULTS; and
5.) The DNA APPLICATION, RESULTS and photographs must include clear documentation that:
a.) PUPPY'S AKC ReUnite Microchip number was used as identifying the instrument during the taking of DNA, and
b.) PUPPY'S microchip number matches the A.K.C. ReUnite microchip implanted in PUPPY by/and Registered to BUYER by BREEDER;
6.) BREEDER shall then submit all documentation to her veterinarian for confirmation of diagnosis;
VIII. BREEDER'S REPLACEMENT PUPPY GUARANTEE;
A.) If PUPPY is found to be genetically unhealthy by the BUYER's veterinarian within 3 (three) days of receipt of PUPPY; and or if PUPPY is diagnosed to be "Affected" by Von Willebrand DiseaseType 1 ( vWF1), Neonatal Encephalopathy, Degenerative Myelopathy, and or Progressive Retinal Atrophy - Progressive Rod Cone Degeneration (PRA-PRCD); and if BUYER has complied with all of the terms, conditions and deadlines herein; and
1.) BREEDER will supply medical records and information provided by BUYER - to BREEDER’s veterinarian - in order to confirm diagnosis of genetic health issues;
2.) If BREEDER’s veterinarian confirms genetic illness not listed under the exclusions to the guarantees contained in this contract, BREEDER shall provide BUYER with a "REPLACEMENT PUPPY", under the terms herein, for free, IE - at no replacement cost to BUYER; and
a.) Said “REPLACEMENT PUPPY” being the first available same sex PUPPY that does NOT have a DEPOSIT on it; and
b.) BUYER can wait for a same sex / same color REPLACEMENT PUPPY which may take considerable more time. BUYER must notify BREEDER of their wanting a same sex / same color REPLACEMENT PUPPY in writing via email to: luxepuffpoodles@yahoo.com; and
c.) BUYER, BREEDER and the REPLACEMENT PUPPY are all held to the same standards, conditions, rights, responsibilities and guarantees as are documented in this contract; and
d.) BUYER is responsible for all of the DELIVERY costs associated with delivering the REPLACEMENT PUPPY to BUYER; and
e.) BREEDER will not under any circumstances refund any portion of the DEPOSIT, the purchase price paid, nor any of the costs of extended care or delivery of the (original) PUPPY - to BUYER; and
3.) BUYER shall email BREEDER at luxepuffpoodles@yahoo.com, written notice of BUYERS final decision to retain or relinquish ORIGINAL PUPPY at the same time they give written notice to BREEDER of genetic illness; and
a.) If BUYER retains ORIGINAL PUPPY, BUYER shall immediately spay or neuter ORIGINAL PUPPY at BUYERS expense, and BUYER continues to be permanently legally and financially responsible for all costs, including all diagnostic and health care costs for treatment of genetic illness of ORIGINAL PUPPY in perpetuity; and
b.) If BUYER relinquishes ORIGINAL PUPPY, BUYER also permanently relinquishes to BREEDER all decision making power and control & financial responsibility for PUPPY (including for all future healthcare costs to treat genetic illness), in perpetuity; and
c.) Immediately after receipt of email written notice of RELINQUISHMENT OF ORIGINAL PUPPY by BUYER is received by BREEDER at luxepuffpoodles@yahoo.com, BREEDER accepts full legal, custodial and financial responsibility for the ORIGINAL PUPPY, and immediately therein absolves BUYER of any and all future healthcare, custody, financial and legal responsibility of the ORIGINAL PUPPY; and
d.) If BUYER does not send notification to BREEDER in writing to luxepuffpoodles@yahoo.com of decision to either relinquish or retain ORIGINAL PUPPY, at the same time of notification of genetic illness; NON NOTIFICATION will be deemed NOTICE of BUYER'S decision to retain ORIGINAL PUPPY and thereby does permanently absolve BREEDER from ANY and ALL financial, and or legal responsibility for ORIGINAL PUPPY, in perpetuity.
IX. PUPPY PURCHASE PRICE, DEPOSITS, PAYMENTS, EXTENDED CARE & DELIVERY:
A.) PURCHASE PRICE: The Rocky Mountain LUXE Puff Poodle PUPPY described herein is sold by the BREEDER to BUYER as a Pet or Service Dog, with LIMITED A.K.C. REGISTRATION under all of the terms, conditions and guarantees documented herein, for the total purchase price of $1500.00.
B.) PAYMENTS:
1.) BREEDER WILL email invoice and contract to BUYER via "SquareUp"; BUYERS Signature and Payment is due immediately (within 24 hours) upon receipt of contract and invoice; All Payments are NON REFUNDABLE; if Signed Contract & Payment are not received by BREEDER within 24 hours of being received by BUYER, BREEDER will cancel contract and Invoice; and
2.) If BUYER, for whatever reason does not choose or take a PUPPY from intended litters, BUYER has 6 months from the date they made their payment in full - to apply said payment to another available PUPPY under the terms of this contract without forfeiture of their payment (see PART II.) B.) of this contract)
3.) ALL PAYMENTS are NON REFUNDABLE and must be made on the emailed invoice by CREDIT / DEBIT CARD; BREEDER does NOT under any circumstances accept payments by any other means, including but not limited to: Credit Card payments made over the phone, Cash, Money Orders, Money Wires, Checks, Certified or Cashier's Checks, Western Union, MoneyGram. Venmo, Zelle, PayPal, or Walmart Money wires; and
4.) Squareup will provide BUYER receipts for all credit card payments;
C.) EXTENDED CARE AND DELIVERY:
1.) BREEDER will not release any PUPPY until PUPPY reaches 8 (eight) weeks of age; and
2.) All Air Cargo DELIVERY and or EXTENDED CARE fees will be invoiced for separately; Upon BUYER'S remittance and BREEDER'S receipt of cleared payment in full for the purchase price of PUPPY, all applicable EXTENDED CARE and or DELIVERY costs, BREEDER will begin to prepare PUPPY for DELIVERY; and
3.) BUYER shall pay BREEDER $100.00 per week for any extended care of PUPPY. BUYER must pay all EXTENDED CARE costs in full before BREEDER will release PUPPY to BUYER; and
4.) BUYER has the following DELIVERY OPTIONS:
a.) PICK UP: BUYER and or their PROXY can pick up PUPPY for no cost; Puppy pickups must be pre scheduled at least 7 days ahead of time. OUR CUSTOMER PUPPY PICKUP TIME is STRICTLY - AND ONLY - at 4 PM, on Thursday, Friday or Saturday; and
b.) AIR CARGO SHIPPING: PUPPY can be SHIPPED/ DELIVERED by BREEDER via ALASKA AIRLINES Pet Cargo Services; BUYER is responsible for and agrees to pay BREEDER for ALL AIR CARGO DELIVERY COSTS incurred in the DELIVERY of PUPPY to BUYER, all of which WILL BE INCLUDED on the shipping invoice: the total price of the Air Cargo ticket including taxes and fees, the Airline Approved Kennel, the Airline Mandated Food and Water Bowls, the Airline Mandated Rabies Vaccination (if necessary for delivery) and a $200.00 AIRFREIGHT DELIVERY Convenience Fee; BREEDER will make all AIR CARGO reservations in cooperation with BUYER'S schedule; and or
c.) GROUND TRANSPORT or AIR NANNY: wherein BUYER HIRES OUTSIDE SERVICE to either DRIVE PUPPY to BUYER'S home, or to FLY with PUPPY under their seat to an airport near BUYER; and
(1) BREEDER will arrange flights or pickup with a GROUND TRANSPORT COMPANY or an AIR TRANSPORT NANNY of BUYERS choosing; and
(2) BUYER is responsible for all costs associated with their PUPPY's GROUND or AIR NANNY TRANSPORT (including a $200.00 AIR CARGO and or PUPPY NANNY Convenience Fee TO BREEDER);
(3) BUYER shall provide BREEDER with emailed written instructions directing BREEDER to release PUPPY to GROUND TRANSPORT Company or AIR NANNY; and
(4) BREEDER will ABSOLUTELY NOT PERMIT any PUPPY that is flying by AIR NANNY to fraudulently travel as a service dog.
X. PUPPY'S A.K.C. & A.K.C. ReUNITE MICROCHIP REGISTRATIONS:
A.) BREEDER will electronically transfer LIMITED A.K.C. REGISTRATION into BUYERS NAME - and – will ENROLL / REGISTER PUPPY's AKC ReUNITE microchip in BUYER'S name electronically after:
1.) Both parties sign and exchange the contract, and
2.) BUYER remits PAYMENT IN FULL For PUPPY, including ALL DELIVERY and EXTENDED CARE CHARGES; BREEDER will email BUYER documentation upon completion of enrollment and registrations.
3.) In the case that BUYER receives a replacement PUPPY from BREEDER:
a.) AFTER BUYER RELINQUISHES original PUPPY back to BREEDER:
(1.) BREEDER will provide BUYER with a replacement PUPPY and will transfer the replacement PUPPY’S AKC Registration & microchip into BUYER’S name - only after
(i) BUYER has physically returned original PUPPY to BREEDER,
(ii) BUYER has provided BREEDER with the signed AKC registration - and all of PUPPY’S health records,
(iii) PUPPY’S microchip and AKC registration has been successfully transferred into BREEDER’S name alone.
b.) AFTER BUYER RETAINS ORIGINAL PUPPY:
(1.) BREEDER will provide BUYER with a replacement PUPPY and will transfer the replacement PUPPY’S AKC registration and microchip into BUYER’S name - only after:
(i) BUYER has spayed or neutered original PUPPY,
(ii) BUYER has provided BREEDER with all of PUPPY’S veterinary records (iii) BUYER has provided BREEDER with the veterinary records, bill and paid receipt of spay or neuter being completed on original PUPPY.
XI. COMMUNICATION AGREEMENT BETWEEN BUYER AND BREEDER:
A.) BUYER hereby agrees to send all written communications to BREEDER via email to: luxepuffpoodles@yahoo.com; BREEDER agrees to reply to any and all emails received from BUYER, with an emailed response back to BUYER. If BUYER RECEIVES NO RESPONSE IN 24 HOURS FROM BREEDER, it means BREEDER DID NOT RECEIVE EMAILED CORRESPONDENCE and BUYER shall text BREEDER (from a phone number that is familiar to BREEDER) to ensure communication is received.
XII. BUYER'S AND BREEDER'S MUTUAL AGREEMENT TO THIS CONTRACT:

I. DEFINITIONS USED HEREIN INCLUDE:
A.) "BUYER" is defined as the signer of this contract;

C.) "PUPPY" is defined as: one Pureblood Standard Poodle PUPPY, who can be registered with the American Kennel Club (herein "A.K.C.");
II. THIS IS A LEGALLY BINDING CONTRACT BETWEEN BREEDER AND BUYER:
A.) This contract constitutes the entire agreement between BREEDER and BUYER with respect to the PUPPY being sold and purchased herein; This non transferable contract documents the sale & purchase of a Rocky Mountain Luxe Puff Poodle, the BREEDER'S health guarantees & both parties rights & responsibilities; BREEDER neither makes nor implies any warranties or guarantees, express or implied, other than those written in this agreement, including without limitation, the warranties of merchantability and fitness; BREEDER shall not under any circumstances refund to BUYER any portion of the DEPOSIT / PURCHASE PRICE / Extended Care / Shipping / and or Delivery Costs received from BUYER; BUYER's signature herein indicates that he / she has read, does understand, and agrees to all the terms and conditions of this Contract;
B.) This contract and the terms herein, including PUPPY purchase price is good for the term of 6 (six) months from the date of BUYER's signing:
1.) BUYER AGREES that, if BUYER signs this contract, pays in full, then fails (for any reason) to pick a PUPPY and instead dies not choose any available PUPPY for longer than a 6 (six) month time period, then:
a.) BUYER shall have abandoned this PUPPY purchase contract, forfeited their payment, and will not be contacted by BREEDER regarding any future litters ( I.E. BUYER cannot "ride the wait list" for longer than a 6 (six) month time period); and
b.) If BUYER - at any time after their abandonment of this contract and forfeiture of their payment at 6 months, decides, that they are ready and wish to complete the purchase of an available PUPPY, then BUYER agrees that the following stipulations shall apply:
(1) BUYER must: fill out a new application and if reapproved by BREEDER, must sign a new updated contract if this contract is out of date / is no longer being used by BREEDER / and has been updated in any way); and
(2) BUYER agrees they shall pay the total difference in price between their original purchase price and the then current purchase price of a PUPPY (if the then current purchase price of a PUPPY is more than what is agreed to herein); and
(3) BREEDER shall subtract BUYER'S original payment from the then current total purchase price for the sale of a PUPPY, the amount of which will then be the amount BUYER agrees shall be due in order to complete their purchase of a PUPPY; and
(4) BUYER shall then be permitted to pick their PUPPY from any available puppies;
III. BUYER'S AND BREEDER’S RESPONSIBILITIES TO HEALTH OF PUPPY:
A.) This Contract, and the GUARANTEES HEREIN, are in place for the entire LIFE OF THE PUPPY; BREEDER has done everything in her power to produce healthy and sound puppies. To that end, BREEDER will supply BUYER with health records documenting the health treatments PUPPY has received, including tail docking, the removal of dewclaws, veterinary health checks, vaccines and deworming treatments; and
1.) BREEDER GUARANTEES that PUPPY is healthy at the time of PICK UP (by BUYER, by Proxy for BUYER and or by GROUND or AIR TRANSPORT arranged and paid for by BUYER); In the case of AIR CARGO DELIVERY, BREEDER Guarantees PUPPY is healthy at the time the airplane lands, which is herein mandated to be “the time of PUPPY DELIVERY/RECEIPT"; and
2.) BREEDER does NOT assume any liability for any injury to and or illness of said PUPPY contracted by or sustained by PUPPY - including eye injuries - after DELIVERY/RECEIPT of PUPPY; and
3.) Some things are out of BREEDER'S control; therefore BREEDER does NOT Guarantee PUPPY against any common or idiopathic ailments including but not limited to: a.) parasites, including coccidia and or giardiasis, and any viral or bacterial diseases / disorders brought on by parasites, b.) retained testicles (cryptorchid), c.) involuted vulva or vagina, d.) umbilical hernias, e.) what PUPPY'S size, weight or final coat color will be at physical / sexual maturity, f.) adolescent "Base Narrow" teeth mis- alignment (see below), g.) ear infections, h.) hip dysplasia and or Luxating Patellas, h.) the development of disqualifying faults, diseases, or disorders, which are due to BUYER's negligence, chance, or environmental conditions, including but not limited to: Vaccinosis (I.E. Vaccine injury), Cancer, Addisons, Autoimmune / Immune Disorders (including Sebaceous Adenitis and or Food / Skin Allergies), Digestive Disorders, Bloat; and
4.) All guarantees outlined in this contract will be null and void if BUYER (a.) fails to provide routine veterinary care, (b.) if PUPPY is spayed or neutered before 24 months of age, (c.) if PUPPY is Bred (intentionally or not), (d.) if PUPPY is injured by accident or neglect or (e.) If PUPPY IS VACCINATED with any vaccines in addition to or other than Distemper, Parvo, Bordetella and or Rabies vaccinations, (f.) if PUPPY has undergone any surgical intervention to any base narrow tooth prior to PUPPY reaching 12 months of age, (g.) and / or if any of the terms of this agreement are not followed by BUYER; and
B.) BUYER agrees to have PUPPY examined by BUYER'S veterinarian at BUYER’s expense, within 3 (three) days of RECEIPT of PUPPY and shall email BREEDER Veterinary documentation of mandatory 3 day health check having been performed; if BUYER does not have PUPPY examined by veterinarian within 3 days, any and all Health Guarantees by BREEDER documented herein are nullified by BUYER'S non compliance of this contract; but does NOT void nor nullify any of BUYER’S responsibilities to PUPPY and to BREEDER; and
1.) In such a case as diagnosis of a genetically unhealthy PUPPY by BUYER'S veterinarian is made within 3 (three) days of DELIVERY:
a.) BUYER shall immediately notify BREEDER of said diagnosis by phone - AND in writing via email to luxepuffpoodles@yahoo.com; and
C.) In order to safeguard against Cancer, Allergies, Addison's, Anaphylactic Shock, Seizures, Brain Damage and countless numbers of Autoimmune Diseases, BUYER will ONLY have PUPPY vaccinated with Distemper, Parvo, Rabies and Bordetella vaccines; Any additional vaccinations administered to PUPPY, at any time during it’s lifetime, without Breeders express written consent, BUYER’S will nullify and void any and all BREEDER health guarantees contained herein; and
D.) In order to safeguard against Hip Dysplasia created by nutritional deficiencies and or overwork / stress before PUPPY’s growth plates have matured, BUYER shall:
1..) refrain from: any strenuous or extended hiking, bike riding with or running, pulling of or placing of weights by / upon / and or with PUPPY until after PUPPY is older than 2 years of age; and
2.) feed PUPPY a "non grain free" dog food rated at 5 stars on www.dogfoodadvisor.com, as low grade dog foods will cause nutritional deficiencies and health issues in your Standard Poodle, and
3.) BUYER shall not feed PUPPY any PURINA dog food products nor any dog food containing GMO Corn, Wheat or Soy, nor any grain free dog food;
E.) BUYER agrees and shall enroll PUPPY and complete basic obedience training and or "Good Citizenship Training" with PUPPY;
1.) BUYER must provide BREEDER with name, phone number, email address, website and contact information for any trainer who trains puppy.
2.) If there are any serious behavioral issues BUYER must:
a.) provide BREEDER with clear, full sized, dated recent videos of said behavior, and place their PUPPY in a 2 week professional dog training course.
b.) mandate that their professional dog trainer communicates directly and openly with BREEDER- and that TRAINER must also provide BREEDER with videos of unwanted behavior if requested by BREEDER.
IV. SPAY/NEUTER, BREEDING, RELINQUISHMENT, REHOMING AND RESALE:
A.) SPAY or NEUTER: BUYER is purchasing PUPPY, as a pet or service dog, with Limited A.K.C. Registration; BUYER shall SPAY or NEUTER PUPPY, after PUPPY reaches 24 months of age, and before PUPPY reaches 25 months of age; (A Vasectomy is not an acceptable "Neutering" for the purposes of this Contract, I.E. - all male PUPPIES must have their testicles removed.)
1.) If spay or neuter is performed either before 24 months of age, or after 25 months of age, all contractual BREEDER health guarantees are null and void, unless BREEDER expressly AGREED to it in writing; and / or unless earlier spay or neuter was deemed necessary by BUYER'S Veterinarian because of a health emergency; and
B.) PROHIBITION AGAINST ANY AND ALL BREEDING: BUYER is expressly PROHIBITED FROM ANY AND ALL BREEDING of PUPPY to any other dog, including accidental breedings, at any time during PUPPY'S lifetime; and
1.) If, prior to spay or neuter being performed, PUPPY does breed with any other dog, and said breeding (intentional or not) produces any offspring, said breeding and offspring VOIDS AND NULLIFIES all contractual BREEDER HEALTH Guarantees, but does NOT void nor nullify any of BUYER’S responsibilities to PUPPY and to BREEDER; BUYER shall notify BREEDER of any and all matings / pregnancies and or of all puppies produced by PUPPY and BUYER shall immediately pay BREEDER an additional $3,000.00; and
2.) If PUPPY is a MALE, BUYER shall have neuter performed on PUPPY immediately after any mating / breeding, regardless of age and or if breeding was intentional or accidental; If PUPPY is a FEMALE, BUYER shall have PUPPY spayed 2 weeks after all puppies have been weaned; and BUYER'S Veterinarian shall provide BREEDER proof of spay or neuter being completed; and
3.) BUYER is further expressly prohibited from SELLING any offspring produced from PUPPY, and shall REHOME any and all puppies; BUYER shall not charge any more than a $100.00 REHOMING FEE per puppy; BUYER is also expressly prohibited from relinquishing any puppies produced to any animal shelter and shall personally keep and care for all puppies until such a time as they have been REHOMED into safe and suitable homes; Further, BUYER shall donate all $100.00 REHOMING FEES collected for said puppies, to their local animal shelter; and
C.) LIFETIME COMMITMENT FOR CARE: BUYER agrees that this purchase of PUPPY is a commitment to care for the PUPPY for PUPPY'S entire lifetime; To that end, BUYER shall not at any time nor for any reason:
1.) SELL PUPPY, nor,
2.) RELINQUISH PUPPY to any animal shelter, nor,
3.) RELINQUISH or REHOME PUPPY to any person or business OTHER THAN BREEDER; and
D.) RELINQUISHMENT: If at any time and/or for any reason, BUYER cannot take proper care of PUPPY and needs to RELINQUISH PUPPY:
1.) BUYER shall immediately notify BREEDER in writing via email and verbally via phone call/text of their need to RELINQUISH PUPPY BACK TO BREEDER and shall immediately transfer the AKC ReUnite Microchip into BREEDER’S name alone and must send BREEDER- via overnight FED EX or IPS (NOT USPS) PUPPY’S signed AKC Registration so BREEDER can immediately transfer the AKC Registration into her name alone;
2.) BREEDER shall have the sole discretion regarding all aspects of REHOMING PUPPY; BREEDER shall (within 2 weeks of BUYER’S RELINQUISHMENT), either:
a.) Transport PUPPY back to her residence, or
b.) Place PUPPY into a suitable and immediate TEMPORARY home or REHOME PUPPY into a PERMANENT home all of which shall be of BREEDER's choosing (I.E. BUYER shall have no decision making power as to into which temporary or permanent home PUPPY will be placed); BREEDER and BUYER shall communicate and work cooperatively to facilitate a fast and easy physical transfer of PUPPY from BUYER'S home to either BREEDER'S home or to a new (temporary or permanent) home; and
3.) RELINQUISHED PUPPY shall NOT be SOLD by either BUYER or BREEDER, but shall be REHOMED by BREEDER, into a safe, loving permanent home, directly from either BUYER’S or BREEDER’S residence (or from temporary home of PUPPY post BUYER'S relinquishment); and
4.) BREEDER (not BUYER) is is sole responsible for finding and choosing PUPPY’S TEMPORARY and or PERMANENT home and shall do so by word of mouth, by advertisements, and/or by utilizing any and all means necessary and available to her; BREEDER (not BUYER) shall screen ALL potential homes (including those suggested by BUYER) until BREEDER (not BUYER) deems a suitable TEMPORARY or PERMANENT HOME - is found; and
a.) In the case of RELINQUISHMENT, BUYER shall NOT be REFUNDED any money by BREEDER; and
E.) Prior to any relinquishment because of behavioral issues - BUYER shall hire a professional IACP CERTIFIED dog trainer for evaluation and will commence a minimum of 2 weeks of professional dog training prior to relinquishment;
V. BREEDER GUARANTEE AGAINST ADULT "BASE NARROW" LOWER CANINE TEETH:
A.) DEFINITION: "Base Narrow" bottom adolescent canine teeth can develop in some young Standard Poodle puppies as there can commonly be insufficient room in their very small, very thin developing jaw for all of their large adolescent and or new adult teeth to sit in proper alignment (on the outside of the upper jaw/gum); This can lead to, for a short time during development, one or both of the bottom two canine teeth poking into the top gum or into the top palate, sometimes causing small holes or indentations in the gum or top palate. "Base Narrow" is not an overbite or an underbite; and
1.) In most other dog breeds with normal sized jaws (such as Boxer, Pit Bull, German Shepherd, Australian Shepard, Pug, Labrador Retriever, Irish Setter, etc...) "Base Narrow" is an inherited genetic malformation as their jaws are large and wide enough for their adolescent teeth to have proper placement and alignment. "Base Narrow" in normally sized jaw dog breeds should be corrected, and the breeding pair should be spayed / neutered to remove the possibility of producing more puppies or dogs with this genetic issue; and
2.) In Standard Poodles, as well as in other thin jawed breeds (such as Greyhounds, Afghans, Borzoi and some Terriers, etc...) "Base Narrow" is a common part of the normal healthy skull / bone / jaw / and tooth development of some puppies; Well bred dogs of these thin jawed breeds will OUTGROW any adolescent "Base Narrow" teeth, which naturally corrects itself as the puppy's skull and jaw grow large and wide enough for their bottom canine teeth to sit correctly in the jaw, resulting in the eventual proper adult tooth / jaw alignment with their top jaw and teeth; and
B.) UNNECESSARY AND DANGEROUS EARLY "BASE NARROW" SURGICAL INTERVENTION FOR STANDARD POODLE PUPPIES: There are unfortunately some unethical or uninformed veterinarians who mislead and scare new Standard Poodle puppy owners, pushing them into what is completely unnecessary, though dangerous and very expensive surgery to remove completely / or shave the tip off of adolescent "Base Narrow" Standard Poodle puppy teeth; and to do so before the puppy's teeth, jaw and skull have time to naturally mature, reach full size and organically reach their correct tooth alignment. Such veterinarians:
1.) financially enrich themselves at great physical cost to the Standard Poodle puppy itself, and at great financial and emotional cost to the unwitting new Standard Poodle puppy owner,
2.) Further, they may do this by providing the new owner completely false, mistaken and or misleading information regarding what Standard Poodle "Base Narrow" is, and or by omitting what "Base Narrow" is in wide jawed dog breeds vs what "Base Narrow" in Standard Poodles is; and
3.) BREEDER hereby unequivocally states that the surgical removal of or "shaving off" the tip of a "Base Narrow" Standard Poodle Puppy tooth PRIOR to PUPPY reaching 12 months of age, in well bred Rocky Mountain Luxe Puff Poodle Puppies are:
a.) Surgical procedures that are dangerous to the puppy itself and,
b.) are almost always completely medically unnecessary; further that these surgeries can cause other medical issues in the PUPPY and later as an adult dog (such as huge gaping holes extending into the skull, missing or shaved bottom canine teeth, nerve damage, dental issues later in life and all or any number of health issues that can develop from them) - that would otherwise not exist if the PUPPY'S teeth and jaw had been permitted to grow unimpeded and naturally develop into what would have otherwise been their proper tooth alignment; and,
4.) BREEDER hereby unequivocally states that all Rocky Mountain Luxe Puff Poodle Puppies with an occurrence of "Base Narrow" bottom canine teeth: are developing correctly as nature intended and that by 12 months of age, 99.999 % of Rocky Mountain Luxe Puff Poodle puppies shall "outgrow their Base Narrow" tooth misalignment after their skull and jaw have grown in size resulting in sufficient room for proper bottom canine teeth placement and alignment (on the outside of / and snugged up against the outside of the top jaw and gum; and,
5.) Adolescent "Base Narrow" teeth are a common occurrence in normal, healthy Standard Poodle puppy skull / jaw / bone / tooth growth and development, BREEDER will NOT support, pay for nor refund any cost of any medical intervention or surgery to any "Base Narrow" Tooth in any PUPPY prior to a PUPPY actually having "Base Narrow" teeth upon reaching 12 months of age; and,
6.) BUYER shall refrain from any medical intervention / surgery to any "Base Narrow" tooth PRIOR to PUPPY reaching 12 months of age; Any BUYER who has any medical intervention / surgery done to a "Base Narrow" tooth prior to PUPPY reaching 12 months of age, does so at their own risk and financial cost; further any early intervention / surgery to any "Base Narrow" tooth to any PUPPY who is younger than 12 months of age will render all BREEDER health guarantees contained in this contract NULL AND VOID; and,
C.) BREEDER GUARANTEE AGAINST ADULT BASE NARROW: This guarantee is subject to the following terms and conditions, all of which are at BUYER'S expense:
1.) If "Base Narrow" bottom canine tooth or teeth are diagnosed by BUYER'S veterinarian to have persisted after PUPPY'S first birthday, BUYER shall immediately notify BREEDER of said diagnosis by phone AND in writing via email to "luxepuffpoodles@yahoo.com"; and
2.) BUYER'S veterinarian shall send BREEDER an email to "luxepuffpoodles@yahoo.com" containing:
a.) The following clear, CLOSE UP, full sized, color, dated digital photographs, taken by BUYER'S veterinarian, (taken without any obstruction blocking or distorting view of the Base Narrow Teeth), specifically of: (1) PUPPY'S CLOSED JAW: taken from the SIDE, clearly showing Base Narrow tooth placement, and; (2) PUPPY'S OPEN JAW, taken from the SIDE, clearly showing Base Narrow tooth placement, and; (3) PUPPY'S OPEN JAW - OF BOTTOM TEETH, taken from in front of the nose looking straight down into the mouth, clearly showing Base Narrow tooth, and; (4) PUPPY'S OPEN JAW - OF UPPER JAW AND TOP PALATE, taken from in front of the nose looking straight up into the mouth, clearly showing where base narrow tooth is protruding into gum or top palate; and (5) PUPPY'S CLOSED JAW, taken from in front of the nose looking straight into the mouth, clearly showing where base narrow tooth is protruding into gum or palate; and
b.) a digital photograph of PUPPY and BUYER in veterinarian's office on the same day photos of base narrow teeth were taken; and
c) a digital photograph of veterinarian’s microchip scanner with PUPPY'S entire microchip number clearly visible; and
d.) a signed letter from veterinarian confirming: (1) They diagnose Base Narrow Canine tooth or teeth, (2) they personally took all photographs, (3) that they personally scanned the microchip number of PUPPY photographed; and
e.) BUYER'S veterinarian shall email BREEDER, 2 to 4 digital radiographs (one of open mouth, one of closed mouth) documenting base narrow tooth to BREEDER at address specified in Part I. B. of this contract; and
3.) BUYER'S veterinarian will email BREEDER a copy of all medical records of the PUPPY and the final bill and all for treatment and or removal of Base Canine tooth or teeth in PUPPY; and
4.) BREEDER hereby Guarantees that if, after reviewing the documentation and medical records - BREEDER'S veterinarian confirms that PUPPY has any "Base Narrow" bottom canine teeth persisting at 12 months of age: BREEDER will refund BUYER up to but not exceeding $600.00 of the total cost of having up to two Base Narrow teeth corrected (removed or shaved) by BUYER'S veterinarian;
VI.) PUPPY IS GUARANTEED AGAINST "AFFECTED" DNA : of Von Willebrand DiseaseType 1 ( vWF1), Neonatal Encephalopathy, Degenerative Myelopathy, and or Progressive Retinal Atrophy - Progressive RodCone Degeneration (PRA-PRCD), under the following terms and conditions:
A.) ALL costs associated with DNA testing as well as those associated with BUYER and or BUYER'S veterinarian(s) complying with these contractual terms/conditions and deadlines - are incurred sole at BUYERS expense; and
B.) BREEDER shall not accept any DNA testing conducted (swabbed and or submitted) by BUYER; DNA testing and submittal must be performed and submitted by BUYER’S veterinarian, who must:
1.) digitally photograph PUPPY and BUYER in veterinarian's office at time of DNA swab; and
2.) swab PUPPY for DNA while scanning, photographing and denoting PUPPY's microchip number on the DNA testing paperwork application and envelope; and
3.) digitally photograph DNA envelope before it is mailed to the testing facility, and then personally submits PUPPY'S DNA for testing, marking themselves as the sole recipient for results; and
4.) Upon receipt of DNA test results denoted "Affected" for Von Willebrand DiseaseType 1 ( vWF1), Neonatal Encephalopathy, Degenerative Myelopathy, and or Progressive Retinal Atrophy - Progressive Rod Cone Degeneration (PRA-PRCD)VwD, BUYER'S veterinarian shall email BREEDER to "luxepuffpoodles@yahoo.com" the following FULL SIZED, timely, clear and clearly legible digital photographs of:
a.) PUPPY and BUYER in their office at time of DNA test,
b.) digital photograph of microchip scanner at time of test with PUPPY'S microchip number clearly legible,
c.) the DNA swab envelope before it was mailed;
d.) the DNA test RESULTS; and
5.) The DNA APPLICATION, RESULTS and photographs must include clear documentation that:
a.) PUPPY'S AKC ReUnite Microchip number was used as identifying the instrument during the taking of DNA, and
b.) PUPPY'S microchip number matches the A.K.C. ReUnite microchip implanted in PUPPY by/and Registered to BUYER by BREEDER;
6.) BREEDER shall then submit all documentation to her veterinarian for confirmation of diagnosis;
VIII. BREEDER'S REPLACEMENT PUPPY GUARANTEE;
A.) If PUPPY is found to be genetically unhealthy by the BUYER's veterinarian within 3 (three) days of receipt of PUPPY; and or if PUPPY is diagnosed to be "Affected" by Von Willebrand DiseaseType 1 ( vWF1), Neonatal Encephalopathy, Degenerative Myelopathy, and or Progressive Retinal Atrophy - Progressive Rod Cone Degeneration (PRA-PRCD); and if BUYER has complied with all of the terms, conditions and deadlines herein; and
1.) BREEDER will supply medical records and information provided by BUYER - to BREEDER’s veterinarian - in order to confirm diagnosis of genetic health issues;
2.) If BREEDER’s veterinarian confirms genetic illness not listed under the exclusions to the guarantees contained in this contract, BREEDER shall provide BUYER with a "REPLACEMENT PUPPY", under the terms herein, for free, IE - at no replacement cost to BUYER; and
a.) Said “REPLACEMENT PUPPY” being the first available same sex PUPPY that does NOT have a DEPOSIT on it; and
b.) BUYER can wait for a same sex / same color REPLACEMENT PUPPY which may take considerable more time. BUYER must notify BREEDER of their wanting a same sex / same color REPLACEMENT PUPPY in writing via email to: luxepuffpoodles@yahoo.com; and
c.) BUYER, BREEDER and the REPLACEMENT PUPPY are all held to the same standards, conditions, rights, responsibilities and guarantees as are documented in this contract; and
d.) BUYER is responsible for all of the DELIVERY costs associated with delivering the REPLACEMENT PUPPY to BUYER; and
e.) BREEDER will not under any circumstances refund any portion of the DEPOSIT, the purchase price paid, nor any of the costs of extended care or delivery of the (original) PUPPY - to BUYER; and
3.) BUYER shall email BREEDER at luxepuffpoodles@yahoo.com, written notice of BUYERS final decision to retain or relinquish ORIGINAL PUPPY at the same time they give written notice to BREEDER of genetic illness; and
a.) If BUYER retains ORIGINAL PUPPY, BUYER shall immediately spay or neuter ORIGINAL PUPPY at BUYERS expense, and BUYER continues to be permanently legally and financially responsible for all costs, including all diagnostic and health care costs for treatment of genetic illness of ORIGINAL PUPPY in perpetuity; and
b.) If BUYER relinquishes ORIGINAL PUPPY, BUYER also permanently relinquishes to BREEDER all decision making power and control & financial responsibility for PUPPY (including for all future healthcare costs to treat genetic illness), in perpetuity; and
c.) Immediately after receipt of email written notice of RELINQUISHMENT OF ORIGINAL PUPPY by BUYER is received by BREEDER at luxepuffpoodles@yahoo.com, BREEDER accepts full legal, custodial and financial responsibility for the ORIGINAL PUPPY, and immediately therein absolves BUYER of any and all future healthcare, custody, financial and legal responsibility of the ORIGINAL PUPPY; and
d.) If BUYER does not send notification to BREEDER in writing to luxepuffpoodles@yahoo.com of decision to either relinquish or retain ORIGINAL PUPPY, at the same time of notification of genetic illness; NON NOTIFICATION will be deemed NOTICE of BUYER'S decision to retain ORIGINAL PUPPY and thereby does permanently absolve BREEDER from ANY and ALL financial, and or legal responsibility for ORIGINAL PUPPY, in perpetuity.
IX. PUPPY PURCHASE PRICE, DEPOSITS, PAYMENTS, EXTENDED CARE & DELIVERY:
A.) PURCHASE PRICE: The Rocky Mountain LUXE Puff Poodle PUPPY described herein is sold by the BREEDER to BUYER as a Pet or Service Dog, with LIMITED A.K.C. REGISTRATION under all of the terms, conditions and guarantees documented herein, for the total purchase price of $1500.00.
B.) PAYMENTS:
1.) BREEDER WILL email invoice and contract to BUYER via "SquareUp"; BUYERS Signature and Payment is due immediately (within 24 hours) upon receipt of contract and invoice; All Payments are NON REFUNDABLE; if Signed Contract & Payment are not received by BREEDER within 24 hours of being received by BUYER, BREEDER will cancel contract and Invoice; and
2.) If BUYER, for whatever reason does not choose or take a PUPPY from intended litters, BUYER has 6 months from the date they made their payment in full - to apply said payment to another available PUPPY under the terms of this contract without forfeiture of their payment (see PART II.) B.) of this contract)
3.) ALL PAYMENTS are NON REFUNDABLE and must be made on the emailed invoice by CREDIT / DEBIT CARD; BREEDER does NOT under any circumstances accept payments by any other means, including but not limited to: Credit Card payments made over the phone, Cash, Money Orders, Money Wires, Checks, Certified or Cashier's Checks, Western Union, MoneyGram. Venmo, Zelle, PayPal, or Walmart Money wires; and
4.) Squareup will provide BUYER receipts for all credit card payments;
C.) EXTENDED CARE AND DELIVERY:
1.) BREEDER will not release any PUPPY until PUPPY reaches 8 (eight) weeks of age; and
2.) All Air Cargo DELIVERY and or EXTENDED CARE fees will be invoiced for separately; Upon BUYER'S remittance and BREEDER'S receipt of cleared payment in full for the purchase price of PUPPY, all applicable EXTENDED CARE and or DELIVERY costs, BREEDER will begin to prepare PUPPY for DELIVERY; and
3.) BUYER shall pay BREEDER $100.00 per week for any extended care of PUPPY. BUYER must pay all EXTENDED CARE costs in full before BREEDER will release PUPPY to BUYER; and
4.) BUYER has the following DELIVERY OPTIONS:
a.) PICK UP: BUYER and or their PROXY can pick up PUPPY for no cost; Puppy pickups must be pre scheduled at least 7 days ahead of time. OUR CUSTOMER PUPPY PICKUP TIME is STRICTLY - AND ONLY - at 4 PM, on Thursday, Friday or Saturday; and
b.) AIR CARGO SHIPPING: PUPPY can be SHIPPED/ DELIVERED by BREEDER via ALASKA AIRLINES Pet Cargo Services; BUYER is responsible for and agrees to pay BREEDER for ALL AIR CARGO DELIVERY COSTS incurred in the DELIVERY of PUPPY to BUYER, all of which WILL BE INCLUDED on the shipping invoice: the total price of the Air Cargo ticket including taxes and fees, the Airline Approved Kennel, the Airline Mandated Food and Water Bowls, the Airline Mandated Rabies Vaccination (if necessary for delivery) and a $200.00 AIRFREIGHT DELIVERY Convenience Fee; BREEDER will make all AIR CARGO reservations in cooperation with BUYER'S schedule; and or
c.) GROUND TRANSPORT or AIR NANNY: wherein BUYER HIRES OUTSIDE SERVICE to either DRIVE PUPPY to BUYER'S home, or to FLY with PUPPY under their seat to an airport near BUYER; and
(1) BREEDER will arrange flights or pickup with a GROUND TRANSPORT COMPANY or an AIR TRANSPORT NANNY of BUYERS choosing; and
(2) BUYER is responsible for all costs associated with their PUPPY's GROUND or AIR NANNY TRANSPORT (including a $200.00 AIR CARGO and or PUPPY NANNY Convenience Fee TO BREEDER);
(3) BUYER shall provide BREEDER with emailed written instructions directing BREEDER to release PUPPY to GROUND TRANSPORT Company or AIR NANNY; and
(4) BREEDER will ABSOLUTELY NOT PERMIT any PUPPY that is flying by AIR NANNY to fraudulently travel as a service dog.
X. PUPPY'S A.K.C. & A.K.C. ReUNITE MICROCHIP REGISTRATIONS:
A.) BREEDER will electronically transfer LIMITED A.K.C. REGISTRATION into BUYERS NAME - and – will ENROLL / REGISTER PUPPY's AKC ReUNITE microchip in BUYER'S name electronically after:
1.) Both parties sign and exchange the contract, and
2.) BUYER remits PAYMENT IN FULL For PUPPY, including ALL DELIVERY and EXTENDED CARE CHARGES; BREEDER will email BUYER documentation upon completion of enrollment and registrations.
3.) In the case that BUYER receives a replacement PUPPY from BREEDER:
a.) AFTER BUYER RELINQUISHES original PUPPY back to BREEDER:
(1.) BREEDER will provide BUYER with a replacement PUPPY and will transfer the replacement PUPPY’S AKC Registration & microchip into BUYER’S name - only after
(i) BUYER has physically returned original PUPPY to BREEDER,
(ii) BUYER has provided BREEDER with the signed AKC registration - and all of PUPPY’S health records,
(iii) PUPPY’S microchip and AKC registration has been successfully transferred into BREEDER’S name alone.
b.) AFTER BUYER RETAINS ORIGINAL PUPPY:
(1.) BREEDER will provide BUYER with a replacement PUPPY and will transfer the replacement PUPPY’S AKC registration and microchip into BUYER’S name - only after:
(i) BUYER has spayed or neutered original PUPPY,
(ii) BUYER has provided BREEDER with all of PUPPY’S veterinary records (iii) BUYER has provided BREEDER with the veterinary records, bill and paid receipt of spay or neuter being completed on original PUPPY.
XI. COMMUNICATION AGREEMENT BETWEEN BUYER AND BREEDER:
A.) BUYER hereby agrees to send all written communications to BREEDER via email to: luxepuffpoodles@yahoo.com; BREEDER agrees to reply to any and all emails received from BUYER, with an emailed response back to BUYER. If BUYER RECEIVES NO RESPONSE IN 24 HOURS FROM BREEDER, it means BREEDER DID NOT RECEIVE EMAILED CORRESPONDENCE and BUYER shall text BREEDER (from a phone number that is familiar to BREEDER) to ensure communication is received.
XII. BUYER'S AND BREEDER'S MUTUAL AGREEMENT TO THIS CONTRACT:

I. DEFINITIONS USED HEREIN INCLUDE:
A.) "BUYER" is defined as:the signor of this contract.

C.) "PUPPY" is defined as: one Pureblood Standard Poodle PUPPY, who can be registered with FULL REGISTRATION with the American Kennel Club (herein "A.K.C.")
II. THIS IS A LEGALLY BINDING CONTRACT BETWEEN BREEDER AND BUYER:
A.) This contract constitutes the entire agreement between BREEDER and BUYER with respect to the PUPPY being sold and purchased herein; This non transferable contract documents the sale & purchase of a Rocky Mountain Luxe Puff Poodle, the BREEDER'S health guarantees & both parties rights & responsibilities; BREEDER neither makes nor implies any warranties or guarantees, express or implied, other than those written in this agreement, including without limitation, the warranties of merchantability and fitness; BREEDER shall not under any circumstances refund to BUYER any portion of the DEPOSIT / PURCHASE PRICE / Extended Care / Shipping / and or Delivery Costs received from BUYER; BUYER's signature herein indicates that he / she has read, does understand, and agrees to all the terms and conditions of this Contract;
B.) This contract and the terms herein, including PUPPY purchase price is good for the term of 6 (six) months from the date of BUYER's signing.
1.) BUYER AGREES that, if BUYER signs this contract, pays the requisite deposit, then fails (for any reason) to pick a PUPPY and instead chooses not to complete the purchase of an available PUPPY for longer than a 6 (six) month time period, then:
a.) BUYER shall have abandoned this PUPPY purchase contract, forfeited their payment, will be taken off the "DEPOSIT LIST" and will not be contacted by BREEDER regarding any future litters ( I.E. BUYER cannot "ride the deposit list" for longer than a 6 (six) month time period unless BREEDER does not produce any puppies in that time period); and
b.) If BUYER - at any time after their abandonment of this contract and forfeiture of their payment at 6 months, decides, that they are ready and wish to complete the purchase of an available PUPPY, then BUYER agrees that the following stipulations shall apply:
(1) BUYER must fill out a new application and if reapproved by BREEDER, must sign an updated contract if this contract is out of date / is no longer being used by BREEDER / and has been updated in any way); and
(2) BUYER agrees they shall pay the total difference in price between their original purchase price / payment and the then current purchase price of a PUPPY (if the then current purchase price of a PUPPY is more than what is agreed to herein); and
(3) BREEDER shall subtract BUYER'S original payment from the then current total purchase price for the sale of a PUPPY which will be the amount BUYER agrees shall be due in order to complete their purchase of a PUPPY; and then BUYER can pick out their PUPPY.
III. BUYER'S AND BREEDER’S RESPONSIBILITIES TO HEALTH OF PUPPY:
A.) This Contract, and the GUARANTEES HEREIN, are in place for the entire LIFE OF THE PUPPY; BREEDER has done everything in her power to produce healthy and sound puppies. To that end, BREEDER will supply BUYER with health records documenting the health treatments PUPPY has received, including tail docking, the removal of dewclaws, veterinary health checks, vaccinations and deworming treatments; and
1.) BREEDER GUARANTEES that PUPPY is healthy at the time of PICK UP (by BUYER, by Proxy for BUYER and or by GROUND or AIR TRANSPORT arranged and paid for by BUYER); In the case of AIR CARGO DELIVERY, BREEDER Guarantees PUPPY is healthy at the time the airplane lands, which is herein known as “the time of PUPPY DELIVERY/RECEIPT.”
2.) BREEDER does NOT assume any liability for any injury to and or illness of said PUPPY contracted by or sustained by PUPPY - including eye injuries - after DELIVERY/RECEIPT of PUPPY; and
3.) Some things are out of BREEDER'S control; therefore BREEDER does NOT Guarantee PUPPY against any common or idiopathic ailments including but not limited to:
a.) parasites, including coccidian or giardiasis, and any viral or bacterial diseases / disorders brought on by parasites; b.) retained testicles (cryptorchid); c.) involuted vulva or vagina; d.) umbilical hernias; e.) what PUPPY'S size, weight or final coat color will be at physical / sexual maturity; f.) or against adolescent "Base Narrow" teeth alignment (see below); g.) ear infections; h.) hip dysplasia and or Luxating Patellas; i.) the development of disqualifying faults, diseases, or disorders, which are due to BUYER's negligence, chance, or environmental conditions, including but not limited to: Vaccinosis, Cancer, Addisons, Autoimmune / Immune Disorders, Digestive Disorders, Bloat and or Allergies; and
4.) All BREEDER health guarantees outlined in this contract will be null and void if BUYER:
a.) fails to provide routine veterinary care; b.) if PUPPY is spayed or neutered before 24 months of age,(unless BREEDER agreed to early spay or neuter in writing); c.) if PUPPY is Bred (intentionally or not); d.) if PUPPY is injured by accident or neglect; e.) If PUPPY IS VACCINATED with any vaccines in addition to or other than Distemper, Parvo, Bordetella and or Rabies vaccinations; d.) if PUPPY has undergone any surgical intervention to any base narrow tooth prior to PUPPY reaching 12 months of age; e.) and / or if any of the terms of this agreement are not followed by BUYER; and
B.) BUYER agrees to have PUPPY examined by BUYER'S veterinarian, at BUYER’s expense, within 3 (three) days of RECEIPT of PUPPY: BUYER must email BREEDER Veterinary documentation of mandatory 3 day health check having been performed; if BUYER does not have PUPPY examined by veterinarian within 3 days, any and all Health Guarantees by BREEDER documented herein are nullified by BUYER'S non compliance of this contract; but does NOT void nor nullify any of BUYER’S responsibilities to PUPPY and to BREEDER; and
1.) In such a case as diagnosis of a genetically unhealthy PUPPY by BUYER'S veterinarian is made within 3 (three) days of DELIVERY:
a.) BUYER shall immediately notify BREEDER of said diagnosis by phone - AND in writing via email to luxepuffpoodles@yahoo.com and follow all agreements herein; and
C.) In order to safeguard against Cancer, Allergies, Addison's, Anaphylactic Shock, Seizures, Brain Damage and countless numbers of Autoimmune Diseases, BUYER will NOT have PUPPY vaccinated with any vaccines other than Distemper, Parvo, Rabies and Bordetella: Any other or additional vaccinations administered to PUPPY, at any time during his or her lifetime, without Breeders express written consent, will nullify and void any and all BREEDER health guarantees contained herein; and
D.) In order to safeguard against Hip Dysplasia created by nutritional deficiencies and or overwork / stress before PUPPY’s growth plates have matured, BUYER must:
1.) refrain from: any strenuous or extended hiking, bike riding with or running, pulling of or placing of weights by / upon / and or with PUPPY until after PUPPY is older than 2 years of age; and
2.) feed PUPPY a NON “grain free" dog food rated at 5 stars on www.dogfoodadvisor.com, as “grain free” and low grade dog foods will cause nutritional deficiencies and health issues in your Standard Poodle, and
3.) BUYER shall not feed PUPPY any PURINA dog food products nor any dog food containing GMO Corn, Wheat or Soy;
E.) If PUPPY exhibits any unwanted and serious behavioral issues BUYER must:
a.) provide BREEDER with clear, full sized, dated recent digital videos of said behavior, and place their PUPPY in a 2 week professional dog training course;
b.) BUYER must provide BREEDER with name, phone number, email address, website and contact information for any trainer who trains puppy and will mandate that their professional dog trainer communicates directly and openly with BREEDER- and that TRAINER must also provide BREEDER with videos of unwanted behavior if requested by BREEDER;
IV. RESPONSIBLE BREEDING, RESALE, RELINQUISHMENT AND REHOMING:
A.) EXPRESS CONTRACTUAL PERMISSION TO BREED: This contract permits BUYER to breed PUPPY once they have reached sexual maturity; and
B.) PROHIBITION AGAINST EXCESSIVE AND IRRESPONSIBLE BREEDING: BUYER is purchasing PUPPY, WITH FULL A.K.C. REGISTRATION AND BREEDING RIGHTS. If PUPPY is female, BUYER shall SPAY PUPPY, BEFORE PUPPY reaches 7 YEARS of age or before she produces 8 litters, whichever comes first; and
1.) BUYER is prohibited from relinquishing any puppies produced by PUPPY into any animal shelter and shall personally keep and care for all puppies until such a time as they have been SOLD into safe and suitable homes; and
C.) LIFETIME COMMITMENT FOR CARE for PUPPY: BUYER agrees that this purchase of PUPPY is a commitment to care for the PUPPY for PUPPY'S entire lifetime; To that end, BUYER shall not - at any time - nor for any reason RELINQUISH PUPPY to any other person and or animal shelter; and
1.) AS BREEDING IS A BUSINESS WITH NECESSARY RETIREMENTS, BUYER can SELL or REHOME, and RELINQUISH PUPPY only under the following conditions:
a.) BUYER can SELL or REHOME PUPPY ONLY AFTER spay or neuter has been performed, and can transfer REGISTRATION with LIMITED AKC REGISTRATION ONLY - to anyone they deem safe, loving, appropriate and able to properly care for PUPPY, but PUPPY SHALL BE SPAYED OR NEUTERED BY THE BUYER named HEREIN - BEFORE - PUPPY is sold or re homed, no matter their age; BUYER must not sell PUPPY to any other breeder to be bred; and
b.) If at any time and/or for any reason - if BUYER cannot take proper care of PUPPY and/or needs to RELINQUISH PUPPY back to BREEDER, BUYER must immediately notify BREEDER in writing via email and verbally via phone call/text of their need to RELINQUISH PUPPY to BREEDER, and upon initial contact with BREEDER, must immediately transfer PUPPY’s AKC ReUnite microchip into BREEDER’s name and mail the SIGNED AKC Registration to BREEDER (by FED EX or UPS)(Not by USPS) so BREEDER can transfer PUPPY’s AKC Registration back into BREEDER’S name alone;
(1.) BREEDER shall have sole discretion and will, within 2 weeks of BUYER’S RELINQUISHMENT, either:
(a.) Transport PUPPY back to her residence, and or
(b.) REHOME PUPPY into a suitable and immediate TEMPORARY or PERMANENT safe, loving home, from either BUYER’S or BREEDER’S residence; and
(2.) BREEDER (not BUYER) is sole responsible for finding/choosing RELINQUISHED PUPPY’S new home and shall do so by word of mouth, by advertisements, and/or by utilizing any and all means necessary and available to her; BREEDER (not BUYER) shall screen ALL potential homes (including those suggested by BUYER) until BREEDER (not BUYER) deems a suitable TEMPORARY or PERMANENT HOME - is found; and
(3.) BUYER shall have no decision making power as to into which temporary or permanent home RELINQUISHED PUPPY will be placed; and
(4.) BREEDER and BUYER will communicate and work quickly and cooperatively to facilitate a fast and easy transfer of RELINQUISHED PUPPY from BUYER to BREEDER and or to new home; and
(5.) In the case of RELINQUISHMENT - BUYER shall NOT be REFUNDED any money by BREEDER;
V. BREEDER GUARANTEE AGAINST ADULT "BASE NARROW" LOWER CANINE TEETH:
A.) BASE NARROW DEFINITION: "Base Narrow" bottom adolescent canine teeth can develop in some young Standard Poodle puppies as there can commonly be insucient room in their very small, very thin developing jaw - for all of their large adolescent and or new adult teeth to sit in proper alignment (on the outside of the upper jaw/gum); This can lead to, for a short time during development, one or both of the bottom two canine teeth poking into the top gum or into the top palate sometimes causing small holes or indentations in the gum or top palate. "Base Narrow" is not an overbite or an underbite.
1.) In most other dog breeds with normal sized jaws (such as Boxer, Pit Bull, German Shepherd, Australian Shepard, Pug, Labrador Retriever, Irish Setter, etc...) "Base Narrow" is an inherited genetic malformation as their jaws are large and wide enough for their adolescent teeth to have proper placement and alignment. "Base Narrow" in normally sized jaw dog breeds should be corrected, and the breeding pair should be spayed / neutered to remove the possibility of producing more puppies or dogs with this genetic issue;
2.) In Standard Poodles, as well as in other thin jawed breeds (such as Greyhounds, Afghans, Borzoi and some Terriers, etc...) - "Base Narrow" is a common part of the normal healthy bone/jaw/and tooth development of the puppy; Well bred dogs of these thin jawed breeds will OUTGROW any adolescent "Base Narrow" teeth, which naturally corrects itself as the puppy's skull and jaw grow large and wide enough for their bottom canine teeth to sit correctly in the jaw, resulting in proper adult tooth / jaw alignment with their top jaw and teeth;
B.) UNNECESSARY AND DANGEROUS EARLY "BASE NARROW" SURGICAL INTERVENTION FOR STANDARD POODLE PUPPIES: There are unfortunately some unethical or uninformed veterinarians who mislead and scare new Standard Poodle puppy owners - pushing them into what is completely unnecessary, dangerous and very expensive surgery - to remove completely / or shave the tip of adolescent "Base Narrow" Standard Poodle puppy teeth; and to do so before the puppy's teeth, jaw and skull have time to naturally mature, reach full size and organically reach natural their correct tooth alignment. Such veterinarians -
1.) financially enrich themselves - at great physical cost to the Standard Poodle puppy itself and at great financial and emotional cost to the new Standard Poodle puppy owner,
2.) they do this by providing the new owner completely false, mistaken and or misleading information regarding what Standard Poodle "Base Narrow" is, and or by omitting what "Base Narrow" is in wide jawed dog breeds vs what "Base Narrow" in Standard Poodles is;
C.) BREEDER hereby unequivocally states that the surgical removal of or "shaving off" the tip of a "Base Narrow" Standard Poodle Puppy tooth PRIOR to PUPPY reaching 12 months of age, in well bred Rocky Mountain Luxe Puff Poodle Puppies are:
1.) procedures that are dangerous to the puppy itself and are completely medically unnecessary; further that these surgeries can cause other medical issues in the PUPPY and later as an adult dog (such as huge gaping holes extending into the skull, missing or shaved bottom canine teeth and all of the myriad of health issues that can develop from them) - that would otherwise not exist if the PUPPY had been permitted to grow and naturally develop into what would have otherwise been their proper tooth alignment; and
D.) BREEDER hereby unequivocally states that all Rocky Mountain Luxe Puff Poodle Puppies with an occurrence of "Base Narrow" bottom canine teeth - are developing correctly as nature intended and that by 12 months of age, and that in 99.999 % of cases, all PUPPY'S will "outgrow their Base Narrow" tooth misalignment after their skull and jaw have grown in size resulting in sufficient room for proper bottom canine teeth placement and alignment (on the outside of / and snugged up against - the outside of the top jaw and gum; and
1.) Because adolescent "Base Narrow" teeth are a common occurrence in normal, healthy Standard Poodle puppy tooth/jaw/bone growth and development, BREEDER will NOT support, pay for nor refund any cost of any medical intervention or surgery to any "Base Narrow" Tooth in any PUPPY prior to a PUPPY actually having "Base Narrow" teeth upon reaching 12 months of age; and
2.) BUYER must not have any medical intervention / surgery to any "Base Narrow" tooth PRIOR to PUPPY reaching 12 months of age; Any BUYER who has any medical intervention / surgery done to a "Base Narrow" tooth prior to PUPPY reaching 12 months of age, does so at their own risk and financial cost; further any early intervention/surgery to any "Base Narrow" tooth to any PUPPY who is younger than 12 months of age will render all BREEDER health guarantees contained herein, NULL AND VOID;
E.) BREEDER GUARANTEE AGAINST ADULT BASE NARROW: This guarantee is subject to the following terms and conditions - all of which are at BUYER'S expense:
1.) If "Base Narrow" bottom canine tooth or teeth are diagnosed by BUYER'S veterinarian to have persisted after PUPPY'S first birthday, BUYER shall immediately notify BREEDER of said diagnosis by phone AND in writing via email to "luxepupoodles@yahoo.com"; and
2.) BUYER'S veterinarian shall send BREEDER an email to "luxepupoodles@yahoo.com" containing:
a.) 2 to 4 digital and digitally dated radiographs (one of open mouth, one of closed mouth of each base narrow tooth) documenting base narrow tooth to BREEDER at address specified in Part I. B. of this contract; and
b.) The following clear, CLOSE UP, full sized, digitally dated, color digital photographs (without any obstruction blocking or distorting view of the Base Narrow Teeth), specifically of:
(1) PUPPY'S CLOSED JAW: taken from the SIDE, with lips pulled back, clearly showing Base Narrow tooth placement, and;
(2) PUPPY'S OPEN JAW, taken from the SIDE, with lips pulled back, clearly showing Base Narrow tooth placement, and;
(3) PUPPY'S OPEN JAW - OF BOTTOM TEETH, taken from in front of the nose looking straight down into the mouth, clearly showing Base Narrow tooth, and;
(4) PUPPY'S OPEN JAW - OF UPPER JAW AND TOP PALATE, taken from in front of the nose looking straight up into the mouth, clearly showing where base narrow tooth has protruded into gum or top palate; and
(5) PUPPY'S CLOSED JAW, taken from in front of the nose looking straight into the mouth, with lips pulled back, clearly showing where base narrow tooth is protruding into gum or palate; and
(6) a digital photograph of PUPPY and BUYER in veterinarian's office on the same day photos of base narrow teeth were taken; and
(7) a digitally dated, digital color photograph of veterinarian's microchip scanner with PUPPY'S entire microchip number clearly visible; and
c.) a signed letter from veterinarian confirming:
(1) They diagnose Base Canine tooth or teeth,
(2) they personally took all photographs,
(3) that they personally scanned the microchip number of PUPPY photographed; and will be personally performing the corrective procedures;
d.) a copy of all medical records and the final bill and all for treatment and or removal of Base Canine tooth or teeth in PUPPY; and
3.) BREEDER hereby Guarantees that if, after reviewing the documentation and medical records - BREEDER'S veterinarian confirms that PUPPY has any "Base Narrow" bottom canine teeth persisting at 12 months of age: BREEDER will refund BUYER up to but not exceeding $600.00 of the total cost of having up to two Base Narrow teeth corrected (removed or shaved) by BUYER'S veterinarian;
VI.) PUPPY IS GUARANTEED for his or her lifetime AGAINST "CARRIER” OR AFFECTED" DNA of Von Willebrand DiseaseType 1 ( vWF1), Neonatal Encephalopathy, Degenerative Myelopathy, and or Progressive Retinal Atrophy - Progressive Rod Cone Degeneration (PRA-PRCD), under the following terms and conditions:
A.) ALL costs associated with DNA testing as well as those associated with BUYER and or BUYER'S veterinarian(s) complying with these contractual terms/conditions and deadlines - are incurred sole at BUYERS expense, and;
B.) BREEDER shall not accept any DNA testing conducted (swabbed and or submitted) by BUYER; DNA testing and submittal must be performed and submitted by a veterinarian of BUYERS choosing, who must:
1.) digitally photograph PUPPY and BUYER in veterinarian's office at time of DNA swab; and
2.) swab PUPPY for DNA while scanning, photographing and denoting PUPPY's microchip number on the DNA testing paperwork application and envelope; and
3.) digitally photograph the DNA envelope before it is mailed to the testing facility, submitting PUPPY'S DNA for testing, marking themselves as the sole recipient for results.
4.) Upon receipt of DNA test results denoted "Carrier” or “Affected" for Von Willebrand DiseaseType 1 ( vWF1), Neonatal Encephalopathy, Degenerative Myelopathy, and or Progressive Retinal Atrophy - Progressive Rod Cone Degeneration (PRA-PRCD), said veterinarian must email BREEDER - to "luxepupoodles@yahoo.com" - the following FULL SIZED, clear and clearly legible digital photographs of:
a.) PUPPY and BUYER at time of DNA test,
b.) microchip scanner at time of test with PUPPY'S microchip number clearly legible,
c.) the DNA swab envelope before it was mailed, (d.) the DNA test RESULTS; and
5.) The DNA APPLICATION, RESULTS and photographs must include clear documentation that:
a.) PUPPY'S AKC ReUnite Microchip number was used as identifying the instrument during the taking of DNA, and
b.) PUPPY'S microchip number matches the A.K.C. ReUnite microchip implanted in PUPPY by/and Registered to BUYER by BREEDER; and
6.) BREEDER shall then submit all documentation to her veterinarian for confirmation of diagnosis: If PUPPY is confirmed by BREEDER’S veterinarian to be a CARRIER or AFFECTED - then BREEDER will provide BUYER with a replacement PUPPY (See Part VIII. of this contract);
VII. BREEDER'S REPLACEMENT PUPPY GUARANTEE;
A.) If PUPPY is found to be genetically unhealthy by the BUYER's veterinarian within 3 (three) days of receipt of PUPPY; and or is diagnosed to be "Carrier” or “Affected" by Von Willebrand DiseaseType 1 ( vWF1), Neonatal Encephalopathy, Degenerative Myelopathy, and or Progressive Retinal Atrophy - Progressive Rod Cone Degeneration (PRA-PRCD), and if BUYER has complied with all of the terms and conditions of the contractual terms and responsibilities herein:
1.) BREEDER will supply all medical records for PUPPY and information provided by BUYER - to BREEDER’s veterinarian in order to confirm diagnosis of genetic health issues;
2.) If BREEDER’s veterinarian confirms genetic illness not listed under the exclusions to the guarantees contained in this contract, BREEDER shall provide BUYER with a "REPLACEMENT PUPPY", under the terms herein, for free, IE - at no replacement cost to BUYER;
a.) Said “REPLACEMENT PUPPY” being the first available same sex PUPPY that does NOT have a DEPOSIT on it; BUYER can wait for a same sex / same color REPLACEMENT PUPPY which may take considerable more time. BUYER must notify BREEDER of their wanting a same sex / same color REPLACEMENT PUPPY in writing via email to: luxepupoodles@yahoo.com
b.) BUYER, BREEDER and the REPLACEMENT PUPPY are all held to the same standards, conditions, rights, responsibilities and guarantees as are documented in this contract;
c.) BUYER is responsible for all of the DELIVERY costs associated with delivering the REPLACEMENT PUPPY to BUYER.
d.) BREEDER will not under any circumstances refund any portion of the purchase price paid, nor any of the costs of extended care or delivery of the (original) PUPPY - to BUYER;
3.) BUYER shall email BREEDER at luxepuffpoodles@yahoo.com, written notice of BUYERS final decision to retain or relinquish ORIGINAL PUPPY at the same time they give written notice to BREEDER of genetic illness.
a.) If BUYER retains ORIGINAL PUPPY, BUYER must immediately spay or neuter ORIGINAL PUPPY at BUYERS expense, and BUYER continues to be permanently legally and financially responsible for all costs, including all diagnostic and health care costs for treatment of genetic illness of ORIGINAL PUPPY in perpetuity;
b.) If BUYER relinquishes ORIGINAL PUPPY, BUYER also permanently relinquishes to BREEDER all decision making power and control & financial responsibility for PUPPY (including for all future healthcare costs to treat genetic illness), in perpetuity; BREEDER can choose to keep or REHOME PUPPY at her sole discretion;
c.) Immediately after receipt of email written notice of RELINQUISHMENT OF ORIGINAL PUPPY by BUYER is received by BREEDER at luxepuffpoodles@yahoo.com, BREEDER accepts full legal, custodial and financial responsibility for the ORIGINAL PUPPY, and immediately therein absolves BUYER of any and all future healthcare, custody, financial and legal responsibility of the ORIGINAL PUPPY.
d.) If BUYER does not send notification to BREEDER in writing to luxepuffpoodles@yahoo.com of decision to either relinquish or retain ORIGINAL PUPPY, at the same time of notification of genetic illness; NON NOTIFICATION will be deemed NOTICE of BUYER'S decision to retain ORIGINAL PUPPY and thereby does permanently absolve BREEDER from ANY and ALL financial, and or legal responsibility for ORIGINAL PUPPY, in perpetuity.
VIII. PUPPY PURCHASE PRICE, DEPOSITS, PAYMENTS, EXTENDED CARE & DELIVERY:
A.) PURCHASE PRICE:
1.) The Rocky Mountain LUXE Puff Poodle PUPPY described herein, is sold by the BREEDER to BUYER - WITH FULL A.K.C. REGISTRATION AND BREEDING RIGHTS, under all of the terms, conditions and guarantees documented within this contract-- for the total purchase price of $3000.00
B.) DEPOSITS AND PAYMENTS:
1.) BREEDER WILL NOT accept any payments for PUPPY from BUYER, until CONTRACT has been signed by both parties; all unsigned CONTRACTS expire 24 hours after receipt by BUYER; BREEDER may cancel any unsigned contracts after 24 hours;
2.) BREEDER will email BUYER contract & invoices via "SquareUp" for all payments that are due; The signed contract and Payment in full is due immediately upon receipt of invoice, (unless otherwise noted on the invoice);
3.) BUYER agrees to one of the following PAYMENT OPTIONS:
a.) ALL PAYMENTS must be made by CREDIT / DEBIT CARD made directly on the Squareup invoice. BREEDER does NOT under any circumstances accept payments by any other means, including but not limited to: Cash, Money Orders, Money Wires, Checks, Certified or Cashier's Checks, Western Union, MoneyGram. Venmo, Zelle, PayPal, or Walmart Money wires; and
4.) BREEDER will provide BUYER receipts for all payments by "SquareUp";
C.) EXTENDED CARE AND DELIVERY:
1.) BREEDER will not release any PUPPY until PUPPY reaches 8 (eight) weeks of age; and
2.) Upon BUYER'S remittance and BREEDER'S receipt of cleared payment in full for the purchase price of PUPPY, all applicable EXTENDED CARE and or DELIVERY costs, BREEDER will begin to prepare PUPPY for DELIVERY; and
3.) BUYER shall pay BREEDER $100.00 per week for any extended care of PUPPY after 9 (nine) weeks of age. BUYER must pay all EXTENDED CARE costs in full before BREEDER will release PUPPY to BUYER; and
4.) BUYER has the following DELIVERY OPTIONS:
a.) PICK UP: BUYER and or their PROXY can pick up PUPPY for no cost; and or
b.) AIR CARGO SHIPPING: PUPPY can be SHIPPED/ DELIVERED by BREEDER via AIR CARGO, IF AIR CARGO SHIPPING IS AVAILABLE; (1) BUYER is responsible for and agrees to pay BREEDER for ALL AIR CARGO DELIVERY COSTS incurred in the DELIVERY of PUPPY to BUYER, all of which WILL BE INCLUDED on the invoice: including the total price of the Air Cargo ticket including taxes and fees, the Airline Approved Kennel, the Airline Mandated Food and Water bowls, and a $200.00 AIRFREIGHT DELIVERY and or PUPPY NANNY Convenience Fee; BREEDER will make all AIR CARGO reservations in cooperation with BUYER'S schedule; and or
c.) GROUND TRANSPORT or AIR NANNY: wherein BUYER HIRES OUTSIDE SERVICE to either DRIVE PUPPY to BUYER'S home, or to FLY with PUPPY under their seat to an airport near BUYER; and
(1) BREEDER will arrange flights or pickup time with a GROUND TRANSPORT COMPANY or an AIR TRANSPORT NANNY of BUYER’s choosing, for their services;
(2) BUYER is responsible for all costs associated with their PUPPY's GROUND TRANSPORT or AIR NANNY TRANSPORT, and
(3) BUYER shall provide BREEDER with emailed written instructions directing BREEDER to release PUPPY to BUYER’s proxy, GROUND TRANSPORT Company or to AIR NANNY; and (4) BREEDER will ABSOLUTELY NOT PERMIT any PUPPY that is flying by AIR NANNY to fraudulently travel as a service dog.
IX. PUPPY'S A.K.C. and A.K.C. ReUNITE REGISTRATIONS:
A.) BREEDER will electronically transfer FULL A.K.C. REGISTRATION into BUYERS NAME - and – will ENROLL / REGISTER PUPPY's AKC ReUnite microchip in BUYER'S name electronically after:
1.) Both parties have signed and exchanged the contract, and
2.) BUYER remits PAYMENT IN FULL For PUPPY, including ALL DELIVERY and EXTENDED CARE CHARGES, and
3.) BUYER has provided BREEDER with documentation of veterinary health check being performed within 3 days of BUYER'S receipt of PUPPY; and
4.) BUYER has provided BREEDER with PUPPY’S official name in writing; and
B.) BREEDER register the AKC registration retroactively to the date BUYER paid in full and will email BUYER documentation upon completion of enrollment and registrations; and
X. COMMUNICATION AGREEMENT BETWEEN BUYER AND BREEDER:
A.) BUYER hereby agrees to send all written communications to BREEDER via email to: luxepuffpoodles@yahoo.com
1.) BREEDER agrees to reply to any and all emails received from BUYER, with an emailed response back to BUYER. If BUYER RECEIVES NO RESPONSE IN 24 HOURS FROM BREEDER, it means BREEDER DID NOT RECEIVE EMAILED CORRESPONDENCE and BUYER shall text BREEDER (from a phone number that is familiar to BREEDER) to ensure communication is received.
XI. BUYER'S AND BREEDER'S MUTUAL AGREEMENT TO THIS CONTRACT:

II. THIS IS A LEGALLY BINDING CONTRACT BETWEEN BREEDER AND BUYER:
A.) This contract constitutes the entire agreement between BREEDER and BUYER with respect to the PUPPY being sold and purchased herein; This non transferable contract documents the sale & purchase of a Rocky Mountain Luxe Puff Poodle, the BREEDER'S health guarantees & both parties rights & responsibilities; BREEDER neither makes nor implies any warranties or guarantees, express or implied, other than those written in this agreement, including without limitation, the warranties of merchantability and fitness; BREEDER shall not under any circumstances refund to BUYER any portion of the DEPOSIT / PURCHASE PRICE / Extended Care / Shipping / and or Delivery Costs received from BUYER; BUYER's signature herein indicates that he / she has read, does understand, and agrees to all the terms and conditions of this Contract;
B.) This contract and the terms herein, including PUPPY purchase price is good for the term of 6 (six) months from the date of BUYER's signing.
1.) BUYER AGREES that, if BUYER signs this contract, pays the requisite deposit, then fails (for any reason) to pick a PUPPY and instead chooses not to complete the purchase of an available PUPPY for longer than a 6 (six) month time period, then:
a.) BUYER shall have abandoned this PUPPY purchase contract, forfeited their payment, will be taken off the "DEPOSIT LIST" and will not be contacted by BREEDER regarding any future litters ( I.E. BUYER cannot "ride the deposit list" for longer than a 6 (six) month time period unless BREEDER does not produce any puppies in that time period); and
b.) If BUYER - at any time after their abandonment of this contract and forfeiture of their payment at 6 months, decides, that they are ready and wish to complete the purchase of an available PUPPY, then BUYER agrees that the following stipulations shall apply:
(1) BUYER must fill out a new application and if reapproved by BREEDER, must sign an updated contract if this contract is out of date / is no longer being used by BREEDER / and has been updated in any way); and
(2) BUYER agrees they shall pay the total difference in price between their original purchase price / payment and the then current purchase price of a PUPPY (if the then current purchase price of a PUPPY is more than what is agreed to herein); and
(3) BREEDER shall subtract BUYER'S original payment from the then current total purchase price for the sale of a PUPPY which will be the amount BUYER agrees shall be due in order to complete their purchase of a PUPPY; and then BUYER can pick out their PUPPY.
III. BUYER'S AND BREEDER’S RESPONSIBILITIES TO HEALTH OF PUPPY:
A.) This Contract, and the GUARANTEES HEREIN, are in place for the entire LIFE OF THE PUPPY; BREEDER has done everything in her power to produce healthy and sound puppies. To that end, BREEDER will supply BUYER with health records documenting the health treatments PUPPY has received, including tail docking, the removal of dewclaws, veterinary health checks, vaccinations and deworming treatments; and
1.) BREEDER GUARANTEES that PUPPY is healthy at the time of PICK UP (by BUYER, by Proxy for BUYER and or by GROUND or AIR TRANSPORT arranged and paid for by BUYER); In the case of AIR CARGO DELIVERY, BREEDER Guarantees PUPPY is healthy at the time the airplane lands, which is herein known as “the time of PUPPY DELIVERY/RECEIPT.”
2.) BREEDER does NOT assume any liability for any injury to and or illness of said PUPPY contracted by or sustained by PUPPY - including eye injuries - after DELIVERY/RECEIPT of PUPPY; and
3.) Some things are out of BREEDER'S control; therefore BREEDER does NOT Guarantee PUPPY against any common or idiopathic ailments including but not limited to:
a.) parasites, including coccidian or giardiasis, and any viral or bacterial diseases / disorders brought on by parasites; b.) retained testicles (cryptorchid); c.) involuted vulva or vagina; d.) umbilical hernias; e.) what PUPPY'S size, weight or final coat color will be at physical / sexual maturity; f.) or against adolescent "Base Narrow" teeth alignment (see below); g.) ear infections; h.) hip dysplasia and or Luxating Patellas; i.) the development of disqualifying faults, diseases, or disorders, which are due to BUYER's negligence, chance, or environmental conditions, including but not limited to: Vaccinosis, Cancer, Addisons, Autoimmune / Immune Disorders, Digestive Disorders, Bloat and or Allergies; and
4.) All BREEDER health guarantees outlined in this contract will be null and void if BUYER:
a.) fails to provide routine veterinary care; b.) if PUPPY is spayed or neutered before 24 months of age,(unless BREEDER agreed to early spay or neuter in writing); c.) if PUPPY is Bred (intentionally or not); d.) if PUPPY is injured by accident or neglect; e.) If PUPPY IS VACCINATED with any vaccines in addition to or other than Distemper, Parvo, Bordetella and or Rabies vaccinations; d.) if PUPPY has undergone any surgical intervention to any base narrow tooth prior to PUPPY reaching 12 months of age; e.) and / or if any of the terms of this agreement are not followed by BUYER; and
B.) BUYER agrees to have PUPPY examined by BUYER'S veterinarian, at BUYER’s expense, within 3 (three) days of RECEIPT of PUPPY: BUYER must email BREEDER Veterinary documentation of mandatory 3 day health check having been performed; if BUYER does not have PUPPY examined by veterinarian within 3 days, any and all Health Guarantees by BREEDER documented herein are nullified by BUYER'S non compliance of this contract; but does NOT void nor nullify any of BUYER’S responsibilities to PUPPY and to BREEDER; and
1.) In such a case as diagnosis of a genetically unhealthy PUPPY by BUYER'S veterinarian is made within 3 (three) days of DELIVERY:
a.) BUYER shall immediately notify BREEDER of said diagnosis by phone - AND in writing via email to luxepuffpoodles@yahoo.com and follow all agreements herein; and
C.) In order to safeguard against Cancer, Allergies, Addison's, Anaphylactic Shock, Seizures, Brain Damage and countless numbers of Autoimmune Diseases, BUYER will NOT have PUPPY vaccinated with any vaccines other than Distemper, Parvo, Rabies and Bordetella: Any other or additional vaccinations administered to PUPPY, at any time during his or her lifetime, without Breeders express written consent, will nullify and void any and all BREEDER health guarantees contained herein; and
D.) In order to safeguard against Hip Dysplasia created by nutritional deficiencies and or overwork / stress before PUPPY’s growth plates have matured, BUYER must:
1.) refrain from: any strenuous or extended hiking, bike riding with or running, pulling of or placing of weights by / upon / and or with PUPPY until after PUPPY is older than 2 years of age; and
2.) feed PUPPY a NON “grain free" dog food rated at 5 stars on www.dogfoodadvisor.com, as “grain free” and low grade dog foods will cause nutritional deficiencies and health issues in your Standard Poodle, and
3.) BUYER shall not feed PUPPY any PURINA dog food products nor any dog food containing GMO Corn, Wheat or Soy;
E.) If PUPPY exhibits any unwanted and serious behavioral issues BUYER must:
a.) provide BREEDER with clear, full sized, dated recent digital videos of said behavior, and place their PUPPY in a 2 week professional dog training course;
b.) BUYER must provide BREEDER with name, phone number, email address, website and contact information for any trainer who trains puppy and will mandate that their professional dog trainer communicates directly and openly with BREEDER- and that TRAINER must also provide BREEDER with videos of unwanted behavior if requested by BREEDER;
IV. RESPONSIBLE BREEDING, RESALE, RELINQUISHMENT AND REHOMING:
A.) EXPRESS CONTRACTUAL PERMISSION TO BREED: This contract permits BUYER to breed PUPPY once they have reached sexual maturity; and
B.) PROHIBITION AGAINST EXCESSIVE AND IRRESPONSIBLE BREEDING: BUYER is purchasing PUPPY, WITH FULL A.K.C. REGISTRATION AND BREEDING RIGHTS. If PUPPY is female, BUYER shall SPAY PUPPY, BEFORE PUPPY reaches 7 YEARS of age or before she produces 8 litters, whichever comes first; and
1.) BUYER is prohibited from relinquishing any puppies produced by PUPPY into any animal shelter and shall personally keep and care for all puppies until such a time as they have been SOLD into safe and suitable homes; and
C.) LIFETIME COMMITMENT FOR CARE for PUPPY: BUYER agrees that this purchase of PUPPY is a commitment to care for the PUPPY for PUPPY'S entire lifetime; To that end, BUYER shall not - at any time - nor for any reason RELINQUISH PUPPY to any other person and or animal shelter; and
1.) AS BREEDING IS A BUSINESS WITH NECESSARY RETIREMENTS, BUYER can SELL or REHOME, and RELINQUISH PUPPY only under the following conditions:
a.) BUYER can SELL or REHOME PUPPY ONLY AFTER spay or neuter has been performed, and can transfer REGISTRATION with LIMITED AKC REGISTRATION ONLY - to anyone they deem safe, loving, appropriate and able to properly care for PUPPY, but PUPPY SHALL BE SPAYED OR NEUTERED BY THE BUYER named HEREIN - BEFORE - PUPPY is sold or re homed, no matter their age; BUYER must not sell PUPPY to any other breeder to be bred; and
b.) If at any time and/or for any reason - if BUYER cannot take proper care of PUPPY and/or needs to RELINQUISH PUPPY back to BREEDER, BUYER must immediately notify BREEDER in writing via email and verbally via phone call/text of their need to RELINQUISH PUPPY to BREEDER, and upon initial contact with BREEDER, must immediately transfer PUPPY’s AKC ReUnite microchip into BREEDER’s name and mail the SIGNED AKC Registration to BREEDER (by FED EX or UPS)(Not by USPS) so BREEDER can transfer PUPPY’s AKC Registration back into BREEDER’S name alone;
(1.) BREEDER shall have sole discretion and will, within 2 weeks of BUYER’S RELINQUISHMENT, either:
(a.) Transport PUPPY back to her residence, and or
(b.) REHOME PUPPY into a suitable and immediate TEMPORARY or PERMANENT safe, loving home, from either BUYER’S or BREEDER’S residence; and
(2.) BREEDER (not BUYER) is sole responsible for finding/choosing RELINQUISHED PUPPY’S new home and shall do so by word of mouth, by advertisements, and/or by utilizing any and all means necessary and available to her; BREEDER (not BUYER) shall screen ALL potential homes (including those suggested by BUYER) until BREEDER (not BUYER) deems a suitable TEMPORARY or PERMANENT HOME - is found; and
(3.) BUYER shall have no decision making power as to into which temporary or permanent home RELINQUISHED PUPPY will be placed; and
(4.) BREEDER and BUYER will communicate and work quickly and cooperatively to facilitate a fast and easy transfer of RELINQUISHED PUPPY from BUYER to BREEDER and or to new home; and
(5.) In the case of RELINQUISHMENT - BUYER shall NOT be REFUNDED any money by BREEDER;
V. BREEDER GUARANTEE AGAINST ADULT "BASE NARROW" LOWER CANINE TEETH:
A.) BASE NARROW DEFINITION: "Base Narrow" bottom adolescent canine teeth can develop in some young Standard Poodle puppies as there can commonly be insucient room in their very small, very thin developing jaw - for all of their large adolescent and or new adult teeth to sit in proper alignment (on the outside of the upper jaw/gum); This can lead to, for a short time during development, one or both of the bottom two canine teeth poking into the top gum or into the top palate sometimes causing small holes or indentations in the gum or top palate. "Base Narrow" is not an overbite or an underbite.
1.) In most other dog breeds with normal sized jaws (such as Boxer, Pit Bull, German Shepherd, Australian Shepard, Pug, Labrador Retriever, Irish Setter, etc...) "Base Narrow" is an inherited genetic malformation as their jaws are large and wide enough for their adolescent teeth to have proper placement and alignment. "Base Narrow" in normally sized jaw dog breeds should be corrected, and the breeding pair should be spayed / neutered to remove the possibility of producing more puppies or dogs with this genetic issue;
2.) In Standard Poodles, as well as in other thin jawed breeds (such as Greyhounds, Afghans, Borzoi and some Terriers, etc...) - "Base Narrow" is a common part of the normal healthy bone/jaw/and tooth development of the puppy; Well bred dogs of these thin jawed breeds will OUTGROW any adolescent "Base Narrow" teeth, which naturally corrects itself as the puppy's skull and jaw grow large and wide enough for their bottom canine teeth to sit correctly in the jaw, resulting in proper adult tooth / jaw alignment with their top jaw and teeth;
B.) UNNECESSARY AND DANGEROUS EARLY "BASE NARROW" SURGICAL INTERVENTION FOR STANDARD POODLE PUPPIES: There are unfortunately some unethical or uninformed veterinarians who mislead and scare new Standard Poodle puppy owners - pushing them into what is completely unnecessary, dangerous and very expensive surgery - to remove completely / or shave the tip of adolescent "Base Narrow" Standard Poodle puppy teeth; and to do so before the puppy's teeth, jaw and skull have time to naturally mature, reach full size and organically reach natural their correct tooth alignment. Such veterinarians -
1.) financially enrich themselves - at great physical cost to the Standard Poodle puppy itself and at great financial and emotional cost to the new Standard Poodle puppy owner,
2.) they do this by providing the new owner completely false, mistaken and or misleading information regarding what Standard Poodle "Base Narrow" is, and or by omitting what "Base Narrow" is in wide jawed dog breeds vs what "Base Narrow" in Standard Poodles is;
C.) BREEDER hereby unequivocally states that the surgical removal of or "shaving off" the tip of a "Base Narrow" Standard Poodle Puppy tooth PRIOR to PUPPY reaching 12 months of age, in well bred Rocky Mountain Luxe Puff Poodle Puppies are:
1.) procedures that are dangerous to the puppy itself and are completely medically unnecessary; further that these surgeries can cause other medical issues in the PUPPY and later as an adult dog (such as huge gaping holes extending into the skull, missing or shaved bottom canine teeth and all of the myriad of health issues that can develop from them) - that would otherwise not exist if the PUPPY had been permitted to grow and naturally develop into what would have otherwise been their proper tooth alignment; and
D.) BREEDER hereby unequivocally states that all Rocky Mountain Luxe Puff Poodle Puppies with an occurrence of "Base Narrow" bottom canine teeth - are developing correctly as nature intended and that by 12 months of age, and that in 99.999 % of cases, all PUPPY'S will "outgrow their Base Narrow" tooth misalignment after their skull and jaw have grown in size resulting in sufficient room for proper bottom canine teeth placement and alignment (on the outside of / and snugged up against - the outside of the top jaw and gum; and
1.) Because adolescent "Base Narrow" teeth are a common occurrence in normal, healthy Standard Poodle puppy tooth/jaw/bone growth and development, BREEDER will NOT support, pay for nor refund any cost of any medical intervention or surgery to any "Base Narrow" Tooth in any PUPPY prior to a PUPPY actually having "Base Narrow" teeth upon reaching 12 months of age; and
2.) BUYER must not have any medical intervention / surgery to any "Base Narrow" tooth PRIOR to PUPPY reaching 12 months of age; Any BUYER who has any medical intervention / surgery done to a "Base Narrow" tooth prior to PUPPY reaching 12 months of age, does so at their own risk and financial cost; further any early intervention/surgery to any "Base Narrow" tooth to any PUPPY who is younger than 12 months of age will render all BREEDER health guarantees contained herein, NULL AND VOID;
E.) BREEDER GUARANTEE AGAINST ADULT BASE NARROW: This guarantee is subject to the following terms and conditions - all of which are at BUYER'S expense:
1.) If "Base Narrow" bottom canine tooth or teeth are diagnosed by BUYER'S veterinarian to have persisted after PUPPY'S first birthday, BUYER shall immediately notify BREEDER of said diagnosis by phone AND in writing via email to "luxepupoodles@yahoo.com"; and
2.) BUYER'S veterinarian shall send BREEDER an email to "luxepupoodles@yahoo.com" containing:
a.) 2 to 4 digital and digitally dated radiographs (one of open mouth, one of closed mouth of each base narrow tooth) documenting base narrow tooth to BREEDER at address specified in Part I. B. of this contract; and
b.) The following clear, CLOSE UP, full sized, digitally dated, color digital photographs (without any obstruction blocking or distorting view of the Base Narrow Teeth), specifically of:
(1) PUPPY'S CLOSED JAW: taken from the SIDE, with lips pulled back, clearly showing Base Narrow tooth placement, and;
(2) PUPPY'S OPEN JAW, taken from the SIDE, with lips pulled back, clearly showing Base Narrow tooth placement, and;
(3) PUPPY'S OPEN JAW - OF BOTTOM TEETH, taken from in front of the nose looking straight down into the mouth, clearly showing Base Narrow tooth, and;
(4) PUPPY'S OPEN JAW - OF UPPER JAW AND TOP PALATE, taken from in front of the nose looking straight up into the mouth, clearly showing where base narrow tooth has protruded into gum or top palate; and
(5) PUPPY'S CLOSED JAW, taken from in front of the nose looking straight into the mouth, with lips pulled back, clearly showing where base narrow tooth is protruding into gum or palate; and
(6) a digital photograph of PUPPY and BUYER in veterinarian's office on the same day photos of base narrow teeth were taken; and
(7) a digitally dated, digital color photograph of veterinarian's microchip scanner with PUPPY'S entire microchip number clearly visible; and
c.) a signed letter from veterinarian confirming:
(1) They diagnose Base Canine tooth or teeth,
(2) they personally took all photographs,
(3) that they personally scanned the microchip number of PUPPY photographed; and will be personally performing the corrective procedures;
d.) a copy of all medical records and the final bill and all for treatment and or removal of Base Canine tooth or teeth in PUPPY; and
3.) BREEDER hereby Guarantees that if, after reviewing the documentation and medical records - BREEDER'S veterinarian confirms that PUPPY has any "Base Narrow" bottom canine teeth persisting at 12 months of age: BREEDER will refund BUYER up to but not exceeding $600.00 of the total cost of having up to two Base Narrow teeth corrected (removed or shaved) by BUYER'S veterinarian;
VI.) PUPPY IS GUARANTEED for his or her lifetime AGAINST "CARRIER” OR AFFECTED" DNA of Von Willebrand DiseaseType 1 ( vWF1), Neonatal Encephalopathy, Degenerative Myelopathy, and or Progressive Retinal Atrophy - Progressive Rod Cone Degeneration (PRA-PRCD), under the following terms and conditions:
A.) ALL costs associated with DNA testing as well as those associated with BUYER and or BUYER'S veterinarian(s) complying with these contractual terms/conditions and deadlines - are incurred sole at BUYERS expense, and;
B.) BREEDER shall not accept any DNA testing conducted (swabbed and or submitted) by BUYER; DNA testing and submittal must be performed and submitted by a veterinarian of BUYERS choosing, who must:
1.) digitally photograph PUPPY and BUYER in veterinarian's office at time of DNA swab; and
2.) swab PUPPY for DNA while scanning, photographing and denoting PUPPY's microchip number on the DNA testing paperwork application and envelope; and
3.) digitally photograph the DNA envelope before it is mailed to the testing facility, submitting PUPPY'S DNA for testing, marking themselves as the sole recipient for results.
4.) Upon receipt of DNA test results denoted "Carrier” or “Affected" for Von Willebrand DiseaseType 1 ( vWF1), Neonatal Encephalopathy, Degenerative Myelopathy, and or Progressive Retinal Atrophy - Progressive Rod Cone Degeneration (PRA-PRCD), said veterinarian must email BREEDER - to "luxepupoodles@yahoo.com" - the following FULL SIZED, clear and clearly legible digital photographs of:
a.) PUPPY and BUYER at time of DNA test,
b.) microchip scanner at time of test with PUPPY'S microchip number clearly legible,
c.) the DNA swab envelope before it was mailed, (d.) the DNA test RESULTS; and
5.) The DNA APPLICATION, RESULTS and photographs must include clear documentation that:
a.) PUPPY'S AKC ReUnite Microchip number was used as identifying the instrument during the taking of DNA, and
b.) PUPPY'S microchip number matches the A.K.C. ReUnite microchip implanted in PUPPY by/and Registered to BUYER by BREEDER; and
6.) BREEDER shall then submit all documentation to her veterinarian for confirmation of diagnosis: If PUPPY is confirmed by BREEDER’S veterinarian to be a CARRIER or AFFECTED - then BREEDER will provide BUYER with a replacement PUPPY (See Part VIII. of this contract);
VII. BREEDER'S REPLACEMENT PUPPY GUARANTEE;
A.) If PUPPY is found to be genetically unhealthy by the BUYER's veterinarian within 3 (three) days of receipt of PUPPY; and or is diagnosed to be "Carrier” or “Affected" by Von Willebrand DiseaseType 1 ( vWF1), Neonatal Encephalopathy, Degenerative Myelopathy, and or Progressive Retinal Atrophy - Progressive Rod Cone Degeneration (PRA-PRCD), and if BUYER has complied with all of the terms and conditions of the contractual terms and responsibilities herein:
1.) BREEDER will supply all medical records for PUPPY and information provided by BUYER - to BREEDER’s veterinarian in order to confirm diagnosis of genetic health issues;
2.) If BREEDER’s veterinarian confirms genetic illness not listed under the exclusions to the guarantees contained in this contract, BREEDER shall provide BUYER with a "REPLACEMENT PUPPY", under the terms herein, for free, IE - at no replacement cost to BUYER;
a.) Said “REPLACEMENT PUPPY” being the first available same sex PUPPY that does NOT have a DEPOSIT on it; BUYER can wait for a same sex / same color REPLACEMENT PUPPY which may take considerable more time. BUYER must notify BREEDER of their wanting a same sex / same color REPLACEMENT PUPPY in writing via email to: luxepupoodles@yahoo.com
b.) BUYER, BREEDER and the REPLACEMENT PUPPY are all held to the same standards, conditions, rights, responsibilities and guarantees as are documented in this contract;
c.) BUYER is responsible for all of the DELIVERY costs associated with delivering the REPLACEMENT PUPPY to BUYER.
d.) BREEDER will not under any circumstances refund any portion of the purchase price paid, nor any of the costs of extended care or delivery of the (original) PUPPY - to BUYER;
3.) BUYER shall email BREEDER at luxepuffpoodles@yahoo.com, written notice of BUYERS final decision to retain or relinquish ORIGINAL PUPPY at the same time they give written notice to BREEDER of genetic illness.
a.) If BUYER retains ORIGINAL PUPPY, BUYER must immediately spay or neuter ORIGINAL PUPPY at BUYERS expense, and BUYER continues to be permanently legally and financially responsible for all costs, including all diagnostic and health care costs for treatment of genetic illness of ORIGINAL PUPPY in perpetuity;
b.) If BUYER relinquishes ORIGINAL PUPPY, BUYER also permanently relinquishes to BREEDER all decision making power and control & financial responsibility for PUPPY (including for all future healthcare costs to treat genetic illness), in perpetuity; BREEDER can choose to keep or REHOME PUPPY at her sole discretion;
c.) Immediately after receipt of email written notice of RELINQUISHMENT OF ORIGINAL PUPPY by BUYER is received by BREEDER at luxepuffpoodles@yahoo.com, BREEDER accepts full legal, custodial and financial responsibility for the ORIGINAL PUPPY, and immediately therein absolves BUYER of any and all future healthcare, custody, financial and legal responsibility of the ORIGINAL PUPPY.
d.) If BUYER does not send notification to BREEDER in writing to luxepuffpoodles@yahoo.com of decision to either relinquish or retain ORIGINAL PUPPY, at the same time of notification of genetic illness; NON NOTIFICATION will be deemed NOTICE of BUYER'S decision to retain ORIGINAL PUPPY and thereby does permanently absolve BREEDER from ANY and ALL financial, and or legal responsibility for ORIGINAL PUPPY, in perpetuity.
VIII. PUPPY PURCHASE PRICE, DEPOSITS, PAYMENTS, EXTENDED CARE & DELIVERY:
A.) PURCHASE PRICE:
1.) The Rocky Mountain LUXE Puff Poodle PUPPY described herein, is sold by the BREEDER to BUYER - WITH FULL A.K.C. REGISTRATION AND BREEDING RIGHTS, under all of the terms, conditions and guarantees documented within this contract-- for the total purchase price of $3000.00
B.) DEPOSITS AND PAYMENTS:
1.) BREEDER WILL NOT accept any payments for PUPPY from BUYER, until CONTRACT has been signed by both parties; all unsigned CONTRACTS expire 24 hours after receipt by BUYER; BREEDER may cancel any unsigned contracts after 24 hours;
2.) BREEDER will email BUYER contract & invoices via "SquareUp" for all payments that are due; The signed contract and Payment in full is due immediately upon receipt of invoice, (unless otherwise noted on the invoice);
3.) BUYER agrees to one of the following PAYMENT OPTIONS:
a.) ALL PAYMENTS must be made by CREDIT / DEBIT CARD made directly on the Squareup invoice. BREEDER does NOT under any circumstances accept payments by any other means, including but not limited to: Cash, Money Orders, Money Wires, Checks, Certified or Cashier's Checks, Western Union, MoneyGram. Venmo, Zelle, PayPal, or Walmart Money wires; and
4.) BREEDER will provide BUYER receipts for all payments by "SquareUp";
C.) EXTENDED CARE AND DELIVERY:
1.) BREEDER will not release any PUPPY until PUPPY reaches 8 (eight) weeks of age; and
2.) Upon BUYER'S remittance and BREEDER'S receipt of cleared payment in full for the purchase price of PUPPY, all applicable EXTENDED CARE and or DELIVERY costs, BREEDER will begin to prepare PUPPY for DELIVERY; and
3.) BUYER shall pay BREEDER $100.00 per week for any extended care of PUPPY after 9 (nine) weeks of age. BUYER must pay all EXTENDED CARE costs in full before BREEDER will release PUPPY to BUYER; and
4.) BUYER has the following DELIVERY OPTIONS:
a.) PICK UP: BUYER and or their PROXY can pick up PUPPY for no cost; and or
b.) AIR CARGO SHIPPING: PUPPY can be SHIPPED/ DELIVERED by BREEDER via AIR CARGO, IF AIR CARGO SHIPPING IS AVAILABLE; (1) BUYER is responsible for and agrees to pay BREEDER for ALL AIR CARGO DELIVERY COSTS incurred in the DELIVERY of PUPPY to BUYER, all of which WILL BE INCLUDED on the invoice: including the total price of the Air Cargo ticket including taxes and fees, the Airline Approved Kennel, the Airline Mandated Food and Water bowls, and a $200.00 AIRFREIGHT DELIVERY and or PUPPY NANNY Convenience Fee; BREEDER will make all AIR CARGO reservations in cooperation with BUYER'S schedule; and or
c.) GROUND TRANSPORT or AIR NANNY: wherein BUYER HIRES OUTSIDE SERVICE to either DRIVE PUPPY to BUYER'S home, or to FLY with PUPPY under their seat to an airport near BUYER; and
(1) BREEDER will arrange flights or pickup time with a GROUND TRANSPORT COMPANY or an AIR TRANSPORT NANNY of BUYER’s choosing, for their services;
(2) BUYER is responsible for all costs associated with their PUPPY's GROUND TRANSPORT or AIR NANNY TRANSPORT, and
(3) BUYER shall provide BREEDER with emailed written instructions directing BREEDER to release PUPPY to BUYER’s proxy, GROUND TRANSPORT Company or to AIR NANNY; and (4) BREEDER will ABSOLUTELY NOT PERMIT any PUPPY that is flying by AIR NANNY to fraudulently travel as a service dog.
IX. PUPPY'S A.K.C. and A.K.C. ReUNITE REGISTRATIONS:
A.) BREEDER will electronically transfer FULL A.K.C. REGISTRATION into BUYERS NAME - and – will ENROLL / REGISTER PUPPY's AKC ReUnite microchip in BUYER'S name electronically after:
1.) Both parties have signed and exchanged the contract, and
2.) BUYER remits PAYMENT IN FULL For PUPPY, including ALL DELIVERY and EXTENDED CARE CHARGES, and
3.) BUYER has provided BREEDER with documentation of veterinary health check being performed within 3 days of BUYER'S receipt of PUPPY; and
4.) BUYER has provided BREEDER with PUPPY’S official name in writing; and
B.) BREEDER register the AKC registration retroactively to the date BUYER paid in full and will email BUYER documentation upon completion of enrollment and registrations; and
X. COMMUNICATION AGREEMENT BETWEEN BUYER AND BREEDER:
A.) BUYER hereby agrees to send all written communications to BREEDER via email to: luxepuffpoodles@yahoo.com
1.) BREEDER agrees to reply to any and all emails received from BUYER, with an emailed response back to BUYER. If BUYER RECEIVES NO RESPONSE IN 24 HOURS FROM BREEDER, it means BREEDER DID NOT RECEIVE EMAILED CORRESPONDENCE and BUYER shall text BREEDER (from a phone number that is familiar to BREEDER) to ensure communication is received.
XI. BUYER'S AND BREEDER'S MUTUAL AGREEMENT TO THIS CONTRACT:
